HomeMy WebLinkAboutResolution - 091175A - Agreement - URA - Coronado Project Area - 09_11_1975KJ: cab 49//AIb�9 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the MAYOR of the CITY OF LUBBOCK BE and is hereby authorize and directed to execute an agreement between the CITY OF LUBBOCK and the URBAN RENEWAL AGENCY of the City of Lubbock for the storage of Electril Transmission Poles in the Coronado Project Area, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minute of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this 11 th day of September 1975. ROY B SS, MAYOR ATTEST: n.e Treua Phillips, City/ecretary-Treasurer APPROVED AS TO FORM: Senter, Jr., C" Attorney A G R E E-M E-N T This agreement, made and entered into by and between the URBAN RENEWAL AGENCY OF THE CITY OF LUBBOCK, TEXAS, hereinafter called "LICENSOR", and THE CITY OF LUBBOCK, TEXAS, hereinafter called "LICENSEE", on the date as hereinafter shown. WITNESSETH: In consideration of the mutual covenants hereinafter stated, the parties hereto agree as follows: (1) LICENSOR hereby grants to the LICENSEE a license to occupy and use, subject to all the terms and conditions hereinafter stated, the following premises; All of that portion of Block Thirty-six (36), Coronado Addition to the City of Lubbock, Lubbock County, Texas, which is contiguous and adjoining the East line of Lot One (1), Coronado Addition, and being all of Block Thirty-six, Coronado Addition to the City of Lubbock, Lubbock County, Texas, now owned by LICENSOR. (2) The premises may be occupied and used by the LICENSEE for the storage and assembly of certain steel transmission poles by LICENSEE or his contractor for a construction project in the area of the said premises, the contractor being Highlines Construction Company of West Wego, Louisianna, and for incidental purposes related to the storage and assembly of said poles, during the period beginning as of thedatehereof and ending on December 31, 1975. (3) LICENSEE hereby agrees to indemnify and shall save LICENSOR harmless from any and all liability for any personal injury, loss of life, or property damage resulting from or in any way connected with the condition or use of the licensed premises, or any means of -ingress thereto or egress therefrom, either suffered or sustained by LICENSEE its agents, employees, invitees or guests or any other person or corporation making a claim or demand by reason thereof. (4) This license is not assignable, and shall terminate as of the date hereinabove specified. Upon termination, LICENSEE shall restore the premises to the condition existing at the time of entry upon the same under this license, and shall remove such installations and appurtenances that may have been installed in connection with the storage and assembly of said transmission poles, and/or any other work done and performed upon the said premises. Any damages to the premises by LICENSEE or that occur during LICENSEE'S use of the premises are agreed to be the responsibility of LICENSEE, and will either be repaired or the costs of repairing such shall be reimbursed by LICENSEE upon reasonable notice to LICENSEE after the expiration hereof.
