WHEREAS, the City Commission of the City of Lubbock has heretofore determined and now finds that due to increased vehicular traffic on l9th Street in the City of Lubbock, it is necessary to open, extend, straighten and widen said l9th Street ; and, WHEREAS, to, accomplish this purpose, it is necessary to acquire for street right of way purposes the f-ee simple title of the land hereafter described; and, WHEREAS, Walice Bogart own said land, and the value and total damages to the owner for the fee simpl title to said land have been appraised in the amount of $750.00 and the Commission finds said amount to be fair and equitable; NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in th City of hubbock, Lubbock County, Texas, to acquired by the City of Lubbock fol. the purpose of opening, extendirig, straightening and widening the public street known and designated as l9th Street , which land is more particularly described as .follows: 0.012 of one acre, ane being out of and a. part of the West /z of hot 4 and all of Lots 5 & 6, Block 5, Ellwood Place Addition, lst Installment, an addition to the City of Lubbock, Lubbock County, Texas , according to a map or .plat of said addition, of record in vol. 98 , page 195, Deed Records of Lubbock County, Texas, which lots were conveyed to Walice Bogart by deed dated 19 Apr. 152, of record in vol. 435 , page 324, Deed Records of Lubbock County, Texas, which 0.012 of one acre of land is more particularly described by metes and bounds as follows: BEGINNING at the Northeast corner of said West 1h of Lot 4; THENCE West, 108.6 feet along the North boundary line of Lots 4, 5, and 6, to a point; THENCE S 84053' E, 109.0 feet, to a point in the East boundary line of said Nest 1z of Lot 4; THENCE North, 9.7 feet along said East boundary line to the place of beginning. THAT the owner(x) of said land be offered, through the Right of Way,Depa t- ment, the amount 'appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation pro- ceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for street purposes.
