Penrod Toles - Section 15 Block A - 07_13_1960 I RE S OLUT ION "` O WHEREAS, the City of Lubbock and the State of Texas, by and through the State Highway Commission, have entered into a contract as empowered and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing j for the location, ponatruction and maintenance of that part ,of the State Highway systerp,. Which has heretofore been designated as Loop 289 by the State Highway Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the City of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in order to make certain highway improvements in connection with said "Loop 289" situated in and adjacent to the City of Lubbock and to the end that this purpose be accomplished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the City of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS J. Penrod Toles awp or have some character interest in land needed for the location, construc- tion and maintenance of said Loop 289, and the value and total damages to the owpers for the fee simple title to said land have been appraised in the amount of 112100.00 and the Commission finds said amount to be fair and requitable; NOW THEREFORE: BE IT RESOLWD BY THE CITY COMKISSION OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in Lubbock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289".as a designated part of the State Highway System, which land is more particularly described as follows: 0.073 of one acre of land, more or less, off the east side of that certain tract of land out of the north one-half of Section 15, Block A, in Lubbock County, Texas, which tract was conveyed to J. P. Toles by deed dated 29 June 155, of record in vol. 581, page 371, Deed Records of Lubbock County Texas, said 0.07P acre tract is more particularly de8cribed by metes and bounds as follows: 'Beginning at the northeast corner of said Toles ,tract, said point being 2838:20 feet east and 1645.67 feet south of the northwest corner of said Section 15, said point also being 152.6 feet northwesterly from and measured at right angles to centerline C.S. 309+86.5 of a proposed relocation of us 87; Thence S 34007.4' W, a distance of 350.84 feet, to a point in the north boundary line of a tract of land conveyed to National Products Manufacturing Company., recorded in vol. 633, page 451, Deed Records of Lubbock County, Texas; Thence S 54*45' E, a distance of 19.85 feet, to a point in the present right-of-way line of US 87; is Thence N 30*30' E, a distance of 183.49 feet along said present right- of-way line to the beginning of a curve to the right, said point being ! 75.0 feet northwest from and measured at right angles to centerline ^� ! C.S. 308+29.7 of present US 87; Thence in a northeasterly direction along said curve to the right, having a radius of 5804.65 feet and a central angle of 8*111 , a distance of 168.34 feet to the point of beginning. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instruc ted to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
