RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the MAYOR of the CITY OF LUBBOCK, BE and is hereby
authorized and directed to execute for and on behalf of the CITY OF
LUB13OCK a Quit Claim Deed in favor of JIM, BOYER, ST. PAUL'S OF
THE PLAINS EPISCOPAL CHURCH, INC., WILLIE LOIS HOFFMAN,
EDNA RUTH WHITE, LENA M. SANDERS, CHESTER PUTTEET and wife,
LILLIAN and COMMERCIAL LAND CONSULTANTS, INC., to CITY OF
LUBBOCK rights in a power line easement and in favor of JIM BOYER to
CITY OF LUBBOCK rights in a public utility easement, attached herewith
which shall be spread upon the minutes of the Council, and as spread upon
the minutes of this Council shall constitute and be a part of this Resolution
as if fully copied herein in detail.
Passed by the City Council this 13th day of March 1975.

QUIT CLAIM DEED
THE STATE dF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK
• THAT the CITY OF LUBBOCK, a Home Rule Municipality in the Count3
of Lubbock, State of Texas, for and in consideration of the sum of ONE AND
N0/100 ($1.00) DOLLARS and other good and valuable consideration to it in
hand paid•by the respective grantees hereinafter named, the receipt of which
is hereby acknowledged, does hereby by these presents ABANDON, DISCLAIM,
RELEASE AND FOREVER QUIT CLAIM unto the said GRANTEES as hereinafte
set forth, all its right, title and interest in and to that certain tracts or
parcels of land lying and being situated in the County of Lubbock, State of
Texas, described as follows, to -wit:
I.
The CITY OF LUBBOCK disclaims, releases, and forever Quit Claims
all its right, title and interest in and to the power line easement interests
next below described unto the following names Grantees (whom the CITY OF
LUBBOCK has been informed respectively owned real estate affected by said po
line easement), to -wit: Jim Boyer, St. Paul's of the Plains Episcopal Church,
Inc., Willie Lois Hoffman, Edna Ruth White, Lena M. Sanders, Chester
Putteet and wife, Lillian and Commercial Land Consultants, Inc.
Said power line easement being described as follows:
s. POWER LINE EASEMENT
That the said power line easement being held by the CITY
OF LUBBOCK as the owner of an unrecorded REA power
line easement as successor in interest thereto, is des-
cribed by metes and bounds as follows:
BEGINNING at a point 156 South and 1480. 6 feet West of
the Northeast corner of Section 28, Block E-2, Lubbock
County, Texas;
THENCE East a distance of 1269. 4 feet to a point in the
West line of Lot 9, Buster Long Addition to the City
of Lubbock, Lubbock County, Texas;
THENCE South along said West line of Lot 9, Buster
Long Addition, a distance of 20.00, feet;
THENCE West a distance of 1269.4 feet;
THENCE North a distance of 20.00 feet to the PLACE OF
BEGINNING.
The West 70 feet of the next above described Tract is also included as
a part of a power line easement granted to the CITY OF LUBBOCK by
GLOVER LEUNBERGER under date of January 30, 1958 of record in Volume
682, Page 239 of the Deed Records of Lubbock County, Texas.
The CITY OF LUBBOCK disclaims, releases, and forever Quit Claims
all its right, title and interest in and to the public utility easement interests
next below described unto JIM BOYER of Lubbock County, -Texas (whom the
CITY OF LUBBOCK has been informed owns the real estate affected by said
public utility easement), to -wit:
PUBLIC UTILITY EASEMENT
That the said public utility easement was granted by JIM
BOYER to the CITY OF LUBBOCK under date of September
6, 1972, and is of record at Volume 1322, Pages 129-130
of the Deed Records of Lubbock County, Texas, and is
described by metes and bounds as follows:
BEGINNING at a point that bears South 295.0 feet and East
1159.4 feet of the Northwest corner of the Northeast one -
quarter of Section 28, Block E-2, Lubbock County, Texas;
THENCE East a distance of 60.00 feet to a point;
THENCE South a distance of 20.00 feet to a point;
THENCE West a distance of 60.00 feet to a point;
THENCE North a distance of 20.00 feet to the POINT OF
BEGINNING.
TO HAVE AND TO HOLD the respective interests unto the respective
Grantees as hereinabove set forth, and to their respective heirs, successors
and/or assigns as the case may be, forever, so that neither the .Grantor,
CITY OF LUBBOCK, its successors, or assigns, nor any person claiming
under it shall at any time hereinafter, have, claim or demand any right to the
title to the aforesaid premises or appurtenances or any part thereof.
Only the interests of the CITY OF LUBBOCK insofar as same applies
to the two tracts of land hereinabove described by metes and bounds are hereby
disclaimed, released, and Quit Claimed unto the respective Grantees as
hereinabove indicated, and all other interests and rights of the CITY OF
LUBBOCK not specifically mentioned above are hereby retained by the CITY
OF LUBBOCK. The CITY OF LUBBOCK bases this Quit Claim Deed solely
upon information and belief as regards the Grantees being owners of real
estate affected by the aforesaid power line easement and/or public utility
easement, and said CITY makes no warranty or representation that said
Grantees do in fact own such real estate, and this instrument is made, executed,
and delivered without warranty, representation or recourse as against the
CITY OF LUBBOCK, in any event.
