HomeMy WebLinkAboutResolution - 032460O - Alley Improvements - City Engineer - Main St. & Broadway - 03_24_1960 0 RESOLITIION WI3EREAS, the City Coz aissiom has heretofore determined that the City would contribute the customary city portion of the cost cf street paving im- provements, ae determined by City of Imbbcck paving policy, to be constructed in accordance with the standard City of Lubbock street plane and specifications as approved by the City Engineer, and the owners of property abutting, have requested permission to have pavement improvements constructed on the afore- mentioned alley and the paving of said alley is weeded to provide access to the area during its construction period, and the City Engineer has approved the plans and specifications for such improvements, and, WEERELS, the crwmera of the property abutting on the herein described street will contract separately with a competent contractor for the above street improvements, and said improvements will be constructed in accordance with the`abovemeutioaned plane and specifications under the supervision of the City Engineer, and the said comers desire that the City contribute its customary share towards such paving, egad, WHEREAS, the City°a share in connsetion therevith 'vounld not exceed $ L86.59 , leaving, the property cumer°s portion not to exceed $1,637.65 such coats being well `within the current prices for paving obtained by competi- tive bidding, -and that such payment to be ms,de by the City is reasonable, fair, and just to the abutting property owners, the City and all other persons affect- thereby, and that the sum will be duly budgeted, THEREFCRE, BE rr RESOLVED BY THE CITY CCMISSION OF THE CITY OF LUBBOCK: section 1. THAT, the City Engineer be and he is hereby authorized to pprove plans and specifications for paving on the elley bzrein described, rovidad that such plains and specifications meet the usual requirements for visng om streets within the corporate limits of the City of Lubbock; said treets being as follows, to-wit: East-,lest alley between 1�ja.in Street and Broadway from its intersection with the West Lip Line of Avenue "S" to its intersection with a Line 337.35 feet West of same, known and designated as Unit Bomber A-328. T�e City Engineer is further authorized and directed to duly inspect said javing construactiom on said alley and to require strict compliance with the pproved"playas nand specifications, end upon completion of said psvin.g, and upon imal approval by the City Engineer and acceptance of such improvements by the ity Co®misaiomm, the City EmisreAr is authorized to pay the contractor in full sad final payment of the City's -bare of the 'cost of the sbovemenationed improve- nte a sun not to exceed $ 390.03 which is the City°s share ($ 486,52 Ass $ 96.56 Ongimmeering, leaving she amount due the contractor from the �^ roperty omers not to emceed $ 1.637.65 Section 2. This authority is conditioned that the owners of abutting roperty and the contractor will pay for all material and labor and costs ncidental to such construction, indemnify the City of Lubbock against any oats, claims or damages of every nature pertaining thereto, and that the ontractor furnish the City Engineer with acceptable evidence that the contractor nd his sub-contractors, if any, are adequately covered by public liability nd property damage insurance policies, that the said owners of abutting property ill cause such paving to continue to be done according to the approved plans nd specifications,• and that upon completion thereof and final approval of the ity Engineer, all improvements designated herein shall be a permanent part of aid arleys and the property of the City of Lubbock, without any liability what- oever, except for the payment of a sum of $ 390.03 to the contractor.
