HomeMy WebLinkAboutResolution - 010975T - ROW Offer - Vernice Ford - FM 2641 Improvements, TDHPT - 01_09_1975RESOLUTION WHEREAS, the City of Lubbock is in the process of acquiring right- of-way, and/or reanestate for the purpose of construction and improvements and extensions to Farm to Market Road and/or Highway No. 2641 and certain access road(s) to the Lubbock Regional Airport and for bona fide public purposewin furtherance of the safety and general welfare of the citizens of the City of Lubbock in particular and travelers in this area in general; and, WHEREAS, the public necessity demands that the real pooperty hereinafter described be acquired by the City of Lubbock for such pur- poses in order that F. M. 2641 and public road access to Lubbock Regional Airport may be improved in cooperation with the Texas Highway Depart- ment (who is to actually contract or cause to be constructed such improve- ments); NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the fee simple title to the following described trac of land be acquired by the City of Lubbock for municipal purposes and the public use and purposes as set forth in the preamble hereof, which tracts of land aggregating a total of approximately 0.762 acres of land, located in Lubbock County, Texas, and being more particularly described as follows: TRACT I. A tract of land out of Section 1, Block D-3, Lubbock County, Texas, containing approximately 0.166 acres of land and being described by metes and bounds as follows: BEGINNING at a point which bears NORTH 010 55' 40" EAST a distance of 2, 649. 52 feet from the southwest corner of Section 1, Block D-3; THENCE a bearing of NORTH 010 55' 40" EAST a distance of 31.13 feet to a point; THENCE a bearing of SOUTH 840 04' 37" EAST a distance of 464. 33 feet to a point; THENCE a bearing of NORTH 870 55' 17" WEST a distance of 463. 21 feet to the PLACE OF BEGINNING. TRACT II. A tract of land out of Section 1, Block D-3, Lubbock County, Texas, containing approximately 0.596 acres of land, and being described by metes and bounds as follows: BEGINNING at a point which bears North 01 *55'40" East a distance u of 2680.65 feet from the Southeast corner of Section 1, Block D-3, Lubbock County, Texas, said point being in the West line of Section 1, Block D-3; THENCE North 01055140" East along the West line of Section 1, Block D-3 aAistance of 638. 87 feet; THENCE South 88 °04120" East a distance of 30. 00 feet; THENCE South 01 °55'40" West a distance of 301. 33 feet; THENCE South 5049120" East a distance of 144. 24 feet to a point of curvature; THENCE 6oQund a curve to the right having a radius of 1155 feet, tangent lengths of 78. 23 feet, chord length of 156. 11 feet and a delta angle of 7 *45' to a point of tangency; THENCE South 01055140" West along a line parallel to and 60 feet East of the West line of Section 1, Block D-3 a distance of 43. 06 feet; THENCE North 84004137" West a distance of 60. 15 feet to the PLACE OF BEGINNING. SECTION II. THAT the owners of said land, including Vernice Ford, be offered, through the Right -of -Way Department, the amount of Three Thousand Two Hundred and No One Hundreds ($3, 200.00) dollars, which is the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted, the City Attorney is hereby authorized and instructed to institute Condemnation Proceedings to acquire the fee simple title to said land as hereinabove described for the purposes aforesaid.
