WHEREAS, the City of Lubbock and the State of Texas, by and through, the State Highway Commission, Have entered into a contract as empowered . `and authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for the location, construction and maintenance of that part of the State Highway system, which has heretofore been designated as Loop 28.9 by the State High- way Commission; and, WHEREAS, under the terms of the contract the procurement and acquisition of the necessary land needed for road right of way purposes is the obligation of the q City'of Lubbock; and, WHEREAS, the State Highway Commission has deemed it necessary in orde to make certain highway improvements in connection with said "Loop 289" situate in and adjacent to!'the. City of Lubbock and. to the end that this purpose be accom- plished, the necessity of which is hereby confirmed by the City Commission of the City of Lubbock, it is necessary that fee simple title to the land hereinafter described be acquired by the Cyr of Lubbock in fulfillment and satisfaction of its contractual obligations to the State of Texas; and, WHEREAS C. C. Worrell and Sid Worrell own.or :have some character inter sf.in=.land needed for the location,: construction and maintenance of said Loop 289, and the value and total damages to the owners for the fee simple title to said land have been appraised in the amount of and the Commission finds said amount to.be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COMMISSION OF THE CI-TY OF LUBBOCK:' THAT the fee simple title to the following described land situated;in Lub- bock County, Texas, be acquired by the City of Lubbock for and on behalf of the State of Texas for the purpose of opening, constructing and maintaining in conjunction with the State Highway Commission, said "Loop 289" as a designated part of the State Highway System, which land is more particularly described as follows: (14A-B) 2.484 acres of land, being all of Block 12, Avalon Addition to the City of Lubbock, a plat of said addition being of record in vol. 559, page 417, Deed Records of Lubbock County, Texas, which Block 12 was conveyed to C.C. and Sid Worrell by deeds dated 7 Aug. '53, and 7 Sept. 154, of record in vol. 508 , page 75, and vol. 545, page 261, Deed Records of Lubbock County, Texas, parcel 14 A being the north part of said Block 12, and contains 1.055 acres, and 14 B being the south part of said Block 12, and contains 10429 acres. �I (68A-x) Eight parcels of land out of Lot 4, Block 11, and Lots 23 thru 29, Block 10, Avalon Addition to the City of Lubbock, Being more particularly described as follows: PARCEL "As' BEGINNING at the southwest corner of Lot 4; thence N 0*04' W, 93.9 feet, to a point in a curve, said point it S 26*09, 17, 215 feet from the center of said curve; thence southeasterly along said curve to the left, a distance of 9.3 feet; thence S 66°201 ,, 107.9 feet to a point in the east line of Lot 4; thence S 45*04, E, 17.6 feet to a point on a curve, said point is N 44056, E, 20 feet frcn the center of said curve; thence westerly along said curve to the right, a distance of 47.1 feet; thence S 89e561 W, 105.5 feet to the place of beginning and contains 0.192 acres. PARCEL nB" All of Lot 23, and contains 0.165 acres. PARCEL "C" BEGINNING at the western most corner of said Lot 24; thence N 44056, E, 118.7 feet along the northeast boundary line of said Lot 24, to a point; thence S 66*20' E. 3.5 feet, to a point in. the northeast boundary line, of said Lot 24; thence S 45005' E. 56.7 feet along said northeast boundary line to the eastern most corner of said Lot 24; thence S 44056, Y1, 120 feet to the southern most corner of said Lot 24; thence N 45104' W. 60 fee to the place of beginning and contains 0,165 acres. PARCEL "H" BEGINNING at the southern roost corner of said Lot 29; thence N 45004' W. 55.0 feet along the southwestern boundary line of said Lot 29, to a point; thence S 66020' E, 59.0 feet to a point in the southeastern boundary line of said Lot 29; thence S 44056' VI. 21.4 feet along said southeastern boundary line to the place of beginning and contains 0.014 acres. 0. THAT the owners of said land be offered, through the Right of Way Depart- ment, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and State of Texas, and unless accepted forthwith the City Attorney is hereby authorized and instructed to institute condemnation proceedings to acquire the fee simple title to said land as hereinabove described for highway purposes.
