RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Contract for Landfill
Litter Pickup by and between the City of Lubbock and Lubbock Regional MHMR
Center, dba L & D Industries of Lubbock, attached herewith, and any associated
documents, which Contract shall be spread upon the minutes of the Council and as
spread upon the minutes of this Council shall constitute and be a part of this Resolution
as if fully copied herein in detail.
Passed by the City Council this 22nd day of January , 1998.

CONTRACT FOR LANDFILL LITTER PICKUP
CITY OF LUBBOCK
LUBBOCK, TEXAS
This contract and agreement is entered into by and between the City of Lubbock (Owner) and the
Performing Agency (Assigned Workcenter), Lubbock Regional MHMR Center, dba L & D
Industries of Lubbock, pursuant to the authority granted in compliance with the provisions of
Chapter 122, Human Resources Code, and certified by Texas Industries for the Blind and
Handicapped (TIBH), as a contract in compliance with the provisions of Chapter 122, Human
Resources Code.
EFFECTIVE DATE: October 1, 1997.
CONTRACT EXPIRATION DATE: September 30, 1998.
ITEMS COVERED BY CONTRACT:
Lubbock Regional MHMR Center, dba L & D Industries of Lubbock herein referred to as the
Performing Agency/Assigned Workcenter shall perform litter pickup for the following location:
1. Solid Waste Landfill, 8425 N. Avenue P.
This listed service shall be performed at the following rates:
1. Client
2. Supervisor
$5.99/Hour
$9.91/Hour
$0.21 /Each
4. General Administrative/Overhead $26.59/Day
Minimum billing per each trip to the landfill shall be three hours and shall include a minimum
of four clients and one supervisor. However, in the event the Performing Agency stops work
prior to the three hour minimum, actual time worked will be billed.
Total payments by the Owner to the Performing Agency shall not exceed THIRTY EIGHT
THOUSAND THREE HUNDRED SEVENTY TWO DOLLARS AND SEVENTY FIVE CENTS ($38372.75).

PRICING: Pricing includes all costs for labor, supervision, insurance, and overhead.
INDEMNITY & INSURANCE: The performing Agency will hold the City of Lubbock harmless from
any claim of liability asserted by reason of the negligence of the Performing Agency, its clients,
agents, servants, and employees in the performance of this agreement. Throughout the term of
this agreement, the Performing Agency will maintain Worker's Compensation and liability
insurance in the following minimum amounts:

occurrence and i n the aggregate.
The Performing Agency shall file proof of insurance with the City Purchasing Manager and will
not cancel coverage without notification to the City Purchasing Manager and provision within
thirty (30) days of proof of insurance with no lapse in coverage.
The Performing Agency shall observe and comply with all Federal State, and local laws, safety
and health regulations, ordinances, and all other ordinances and regulations which in any
manner affect the conduct of the work.
This contract may be canceled without penalty by either party by providing thirty (30) days
written notice to the other party.
THIS CONTRACT IS ISSUED UNDER CHAPTER 122 OF THE HUMAN RESOURCES CODE AS PART OF
THE STATE OF TEXAS, STATE USE PROGRAM. Attorney General Opinion JM-444, dated February
21, 1986, permits the purchase of products and/or services from non-profit workcenters
without engaging in competitive bidding as long as the requirements of the statute are met.

THE UNDERSIGNED PARTIES do hereby certify that, (i) the services specified above are
necessary and essential for activities that are properly within the statutory functions and
programs of the affected parties of Local and State Government, and (ii) the services, supplies
or Contract, are not required by Section 21 of Article XVI of the Constitution of Texas to be
supplied under Contract given to the lowest responsible bidder.
