HomeMy WebLinkAboutResolution - 080874A - Permission For Utility Companies To Change Rates - 08_08_1974KJ:dw RESOLUTION WHEREAS, the City Council receives, from time to time, requests from public utility companies operating within the City of Lubbock, that the City Council grant them permission to change the rates for utility services; and, WHEREAS, it has been determined that a procedure be established for the filing of such requested change, the study of such request by the City staff and the consideration by the City Council; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the following procedure is hereby established to be followed when public utility companies request rate changes or approval of proposed rate changes by the City Council: (1) Requests for rate changes or requests for approval of rate changes shall be made in writing addressed to the City Council and presented or mailed to the City Secretary. The City Secretary shall immediately notify the City Manager. (2) The City Manager shall cause to be assembled the necessary background informatioi relative to such request and may refer such request to the appropriate City Departments for study and recommendations. (3) The information assembled by the City Manager shall be delivered to the Mayor and City Council for review, (4) The City Council shall set a date for a public hearing and consideration of the requested rate change. (5) The utility company requesting such rate change shall be notified of the date of the hearing in order that a representative may make an oral presentation. (6) The City Council may request any additional information it deems necessary to such determination. (7) The City Council may refer the rate request to City Departments, City Boards and/or outside consultants if necessary. (8) The City Council may refer such rate request to the Electric Utility Board, if appropriate. (9) The studies directed by the City Council shall be returned to the City Council in writing on the date specified by the City Council and/or an oral presentation made before the City Council in a public hearing.
