R E S O L U T I O N_
<a
WHEREAS, the City of Lubbock owns certain property located within
Section 2, Block B, Lubbock County, Texas, and the City Commission finds
that the property hereinafter described in the body .of this Resolution is no
longer needed by the City of Lubbock; and,
WHEREAS, the City Commission further finds that Omer A. Dreiling
desires to purchase said excess property for the development of a rendering
plant or an allied industry, and the City Commission finds that it would be
expedient and would be;to .the.public interest to sell said property to Omer A.
Dreiling; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1, THAT the Mayor BE and he is hereby authorized and directed to
execute for and on behalf of the City of Lubbock a Warranty Deed from the City
of Lubbock to Omer Ai' Dreiling covering the following described property,to-wit:

BEGINNING ;at a point 945. 16 feet North and 713.63 feet
East of the Southwest corner of Section 2, Block B, Lubbock
County, Texas s;
THENCE Southeasterly along a fence line that makes an angle
of 720 281 with the centerline of the Fort Worth and Denver
Railroad a 4stance of 577.20 feet to a point;
THENCE Southwesterly parallel to and 630.29 feet Southeasterly
from said centerline as measured at right angles to said center-
line a distance of 391. 73 feet to a point;
THENCE Northwesterly at an angle of 720 28? with the center-
line of the Fort Worth and Denver Railroad adistance of 453.45 feet
to the Southeast corner of the 218 foot R. O. W. line of said
Fort Worth and Denver Railroad;
THENCE Northwesterly along the East R. O. W. line of the Fort
Worth and Denver Railroad a distance of 118 feet to a point in
the South R. 'O. W. line of said Fort Worth and Denver Railroad;
THENCE Northeasterly along said South R. O. W. line a distance
of 429.01 feet to the POINT OF BEGINNING and contains 5 acres,
more or 1esi,, and
said deed to be delivered to Omer A. Dreiling upon delivery to the City of
Lubbock of the consideration of $3000. 00.
SECTION 2. Said deed shall contain .an exception that such property shall be used
for a rendering :plant'or allied industry within two (2) years from the date of
purchase, or the City shall have the right to re-purchase the property for the
same consideration as aid by the grantee in the deed. Said deed shall further
contain provisions fo' t, e.removal or purchase by the City of any improvements
placed on such land, if!,the City re-purchases such property. The deed shall
�^ further contain'provision for the execution of a release of the option to re-purchas
as set out above, if.thei property conveyed be devoted'to the use of a rendering
plant or allied industry;as set out above.
SECTION 3. Said deed shall also contain a provision for the right of access to
r the property conveyed therein across other property owned by the City. s�

SECTION 4. There shall be reserved to the City from the property conveyed !
in said deed an easement described as follows:
A 10 foot permanent easement on the South and East of the

following described centerline of an. existing sewer line now
on the premises and a 40 foot permanent easement on the
North and West of said centerline of the existing sewer line a
now on the premises.
BEGINNING at a point in the South R. 0. W. line of the Fort
Worth and Denver Railroad, said point being 748.0 feet North i
and 513. 0 feet East of the Southwest corner of Section 2,
Block B, Lubbock County, Texas;
THENCE Southeasterly at right angles to the centerline of the
Fort Worth and Denver Railroad a distance of 21Z. 1 feet to a
point;
THE .Southwesterly at an angle of 70 03� with the South
R. 0. W. line of the Fort Worth and Denver Railroad a distance
of 186. 0 feet,to a`point, paid point being 451.2 feet North and
54:4,•8 feet East of the Southwest corner of Section 2, Block B,
Lubbock County, 'Texas;
together with the limitation that no building shall be built across the easement
without permission from the City of Lubbock.
SECTION 5,. The City Secretary is hereby authorized and directed to attest
the signature of the Mayor of the City of Lubbock to said deed and to affix the
seal of the City of Lubbock thereto.
