HomeMy WebLinkAboutResolution - 061374K - Abandoned Vehicle Removal Agreement - LBK Wrecker Service - 06_13_1974I' 1%',J:EW_ 74/ RESOLUTION i BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and dir- ected to execute for ,and on behalf of the City of Lubbock an ABANDONED VEHICLE REMOVAL AGREEMENT BETWEEN THE CITY OF LUBBOCK AND LUBBOCK WRECKER SERVICE attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall consti- tute and be a part of this Resolution as if fully copied herein in detail. I� Passed by the City Council this 13th day of June 1974. i ROY 6S, MAYOR ATTEST: { Treva Phillips, City Seqfetary-Treasurer APPROVED AS TO FORM: Fred O; Senter, Jr. jrCAW Attorney ABANDONED VEHICLE REMOVAL AGREEMENT THE STATE OF TEXAS COUNTY OF LUBBOCK THIS AGREEMENT entered into between the CITY OF LUBBOCK, hereinafter called "City" and LUBBOCK WRECKER SERVICE hereinafter called Contrachbr for the removal and storage of abandoned vehicles within the City of Lubbock; on the date hereinafter shown: WITNESSETH: 1. Contractor hereby agrees to, upon order of the police, pick up vehicles designated as abandoned by State Law. These vehicles will be picked up within forty-eight (48) hours after notice is given the Contractor in writing. This notice shall be a form provided by the City. This form will require a full inventory of each vehicle. 2. The Contractor shall provide storage in a protected area for all vehicles. They shall remain in storage for up to ninety (90) days, until sold by the City at public auction. 3. The Contractor shall be responsible for the keeping of records incidental to the removal and storage of such vehicles and such records shall be available to the City of Lubbock and the State of Texas. 4. The Contractor shall provide the City with a performance bond in the amount of $5, 000.00. They shall also have in effect, an insurance policy to cover liability for their wrecker service and loss to the stored vehicles due to fire and theft. The City shall require proof of this insurance in such amount as to offer protection for the number of vehicles impounded. 5. The Contractor shall hold the City free from any liability or responsibility for the acts of the Contractor, its agents or employees in the performance of such services. The Contractor agrees that for $ 17.00 per vehicle, he will pick up, store and protect for the time stated above as well as keep and provide the City with the records and services required. 7. The term of this agreement shall be for a period of twelve months and the additional period of time required to dispose of the vehicles on hand at the end of the term. This agree- ment may terminated only upon 30 days written notice to the other party. Executed this' 13th day of ,tune r 1974.
