RESOLUTION
WHEREAS, the City Commission of the City of
Lubbock finds that the general safety and welfare of the general
public requires the acquisition of clear zones and extensions
thereof for the protection of the North-South instrument runway
at the Lubbock Municipal Airport, and
WHEREAS, the City Commission of the City of Lubbock
finds that public convenience and necessity regiire the acquisi-
tion of clear zones and extensions for the protection of the North-
South instrument runway at the Lubbock Municipal Airport, and
WHEREAS, appraisals have been secured determining the
fair and reasonable value of the properties, property rights,
and easements required for such clear zones, and
WHEREAS, the City Commission of the City of Lubbock
finds it is necessary to acquire the hereinafter described pro-
perty and easements for the public purpose of extending the North-
South instrument runway at the Lubbock Municipal Airport and
finds that it is necessary to acquire clear zones for the protection
of the No rth-South instrument runway at the Lubbock Municipal
Airport for such public purpose.
NOW THEREFORE
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF LUBBOCK, TEXAS THAT:
SECTION 1:
That the following described tracts of land and interest
therein is needed for the public purpose of extending the use
of the Lubbock Municipal Airport and for the protection of
the airport property as well as the nearby residents and
that there is a need to acquire the following properties,
property rights and easements for the extension of the
North-South instrument runway and as clear zones:
(a) Fee simple title to the following described tract
of land situated in Lubbock County, Texas:

YYY. BEGINNING at the Northwest (NW) corner of the
Northeast Quarter (NE/4) of Section Thirty-two
(32), Block A. of Lubbock County, Texas;
THENCE East a distance of 121. 4 feet to a
point;
THENCE South parallel to and 121. 4 feet East
of the West line- of said Northeast Quarter (NE/4)
of Section Thirty-two (32), Block A, a distance
of 1980 feet to a point for the place. of beginning;
THENCE West a distance of 1005 feet to a point
for the Southwest corner of this tract;
THENCE North parallel to and 883. 6 feet West
of the West line of the Northeast Quarter (NE/4)
of Section Thirty-two (32), Block A. a distance
of 460 feet to a point for the Northwest corner
of this tract;
THENCE East a distance of 1255 feet parallel to
the North section line of Section Thirty-two (32),
Block A, to a point for the Northeast corner of
this tract;
THENCE South parallel to the West line of said
Northeast Quarter (NE/4) of Section Thirty-two
(32), Block A, a distance of 460 feet to a point
for the Southeast corner of said tract;
THENCE West a distance of 250 feet to the place of
beginning, and containing 13. 25 acres of land.
(b) Easements as hereinafter set out and described over,
under and across the following described tracts of
land situated in Lubbock County, Texas:
BEGINNING at the Northwest Corner of the tract
first hereinabove described,
THENCE North a distance of 200 feet to a point
for the Northwest corner of this tract;
THENCE East a distance of 1005 feet to a point
for the Northeast corner of this tract;
THENCE,South a distance of 200 feet to a point
in the North line of the tract first hereinabove
described for the Southeast corner of this tract;
THENCE West a distance of 1005 feet for the South-
west and beginning corner of this tract, and con-
taining 4. 61 acres of land.
(c) BEGINNING at a point 427. 5 feet East (E) of the
Ito
Southwest (SW) corner of the 4. 61 acre tract last
hereinabove described, for the Southwest (SW) and
beginning point of this tract;
THENCE North a distance of 200 feet to a point for
the Northwest corner of this tract;
THENCE East a distance of 150 feet to a point for
the Northeast corner of this tract;
THENCE South a distance of 200 feet to a point for
the Southeast corner of this tract;
THENCE West a distance of 150 feet to the South-
west and beginning point of this tract.
The easements found.and determined_ to be necessary as
above set out are as follows:
For the properties hereinabove described under (b),
a perpetual avigation easement and right of way for
the unobstructed and unrestricted flight of aircraft
in, through and across the air space over and above
the tract. of land .last hereinabove described at any
and all altitudes or heights above the surface of the
land together with the right to prevent the erection
or maintenance of any buildings, structures, objects
and facilities and the right to prevent the growth of
trees and other vegetation upon the land, other than
normal agricultural crops which do not exceed a
height of six (6) feet above the surface of the land,
and the right to prevent any usage of the land in any
manner that might attract or bring together an assembly
of persons thereon, together with the right of entry
for the purpose of removing and preventing the con-
struction or erection of any buildings, structures and
facilities and the growth of any trees, vegetation and
other objects upon the land other than those herein
expressly excepted.
For the properties hereinabove described under (c),
the free and uninterrupted uses, liberties, privileges
and rights so acquired shall permit the construction,
erection, maintenance, operation and use on, over and
across said land of a high intensity approach lighting
system as a navigational and approach aid for aircraft
to the hubbock Municipal Airport, including the right

to lay and maintain underground electrical power lines
and systems for the purpose of furnishing electrical
power to such lighting system, and including the right
to erect poles, standards and electrical fixtures,
conduits, transformers, guy wires and other electrical
equipment and aids necessary to the proper function-
ing and maintenance of said lighting system, and fur-
ther with the right to make improvements and repairs,
replacements and additions to such system, equipment
and properties, together with the right of free ingress,
egress and regress to and from said items, equipment
and properties as may be necessary and convenient at
all times and seasons forever, in, along, upon, under
and across said land, in common, however, with the
owners, their tenants, heirs and assigns; provided,
however, that said improvements above referred to shall
be constructed and maintained in a manner with as little
damage to said premises as may be practical considering
the nature of the construction, improvements, additions,
operation and maintenance; together with the right to
erect, construct and maintain a roadway or road-
ways over and across said land for the purpose of
carrying out the above and foregoing rights, priv-
ileges, liberties and uses, provided, however, that
said roadways may be used in common with the owners,
their tenants, heirs and assigns.
SECTION 2:
The special attorneys for the City of. Lubbock, Croslin
& Pharr, are hereby authorized and directed to make
formal offers of $10, 000. 00 for fee simple title to the
13. 25 acre tract first hereinabove described and the sum
of $3, 500. 00 for the easements, rights and privileges
over, under and across the 4. 61 acre tract second here-
inabove described, such offers to be made to the owners
of said land for and on behalf of the City of Lubbock,
Texas, and in the event said offer is not accepted with-
in ten (10) days ffom the date such offer is made and
communicated to said owners, said attorneys are hereby
authorized and directed to institute legal proceedings
in condemnation in the name of and for and on behalf of
the City of Lubbock, Texas against C. E. Hobgood and

all others known or found to have an interest in such
tracts of land.
Upon motion of Commissioner Baker, seconded by Commis-
sioner Casey, the foregoing resolution was approved by unanimous
vote of the City Commission of the City of Lubbock this the
22nd day of August, 1957.
