BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Warranty Deed in
favor of THE STATE OF TEXAS, attached herewith which shall be spread upon
the minutes of the Council and as spread upon the minutes of this Council shall
constitute and be a part of this Resolution as if fully copied herein in detail.
Passed by the City Council this 24th day of January , 1974.

That City of Lubbock, a Texas Home Rule Municipality, acting by and
through its Mayor hereunto duly au tlorized

to as Grantors, whether one or more, for and in consideration of the sum of5O% reimburse-

to Grantors in hand paid by the State of Texas, acting by and through the State
Highway Commission, receipt of which is hereby acknowledged; and for which no lien
is retained, either expressed or implied, have this day sold, and by these presents -
do Grant, Bargain, Sell and Convey unto the.State-of Texas, all that certain tract
or parcel -of land in Lubbock County, Texas, and being more particu-
larly described as follows, to wit:
Being 3834 Sq. Ft. out of Lot 20, Block 5, Baker Subdivision of Roberts'& McWhorter
Addition according to a plat of said Addition recorded in Volume 26, Page 120, of
Plat Records of Lubbock County; and being the same property described in as Deed"
from Harold Blank, et ux, Elva, to James R. Ga=ill, dated May 3, 1951, recorded
in Volume 422, Page 77, Deed Records of Lubbock County, Teras;:said 3834 Sq. Ft.
of land being more particularly described by zetes and bounds as follows:
Beginning at a point in the East line of Lot 20, Block 5, Baker Subdivision,
said point being 10 feet North of the Southeast corner o£"Lot 20, Bieck 5;

And for the same consideration described above, and upon the some conditions,
grantor does hereby bargain, sell, and convey unto the State of Texas.that
portion of the following structure -located on the remaining property out of
which the above described premises were originally a portion, to wit:
Frame Residence Item A.
The owner understands end agrees that it will.be necessary for the State to
enter upon his remaining property out of which the above described property
was conveyed for the purposes of removing that portion of the above described
structure which is located on such owner's remaining property. The ownervhereby
authorizes the State, its agents or assigns, to enteri,upon such remaining property
for purposes of removing such structure and expressly waives all damages or claims
that may result to the remaining property of the owner as a result of such entry
andremoval of such structure.
SAVE and EXCEPT,t,HOWEVERi,it, is expressly understood and .agreed'that. Grantors..are.:
retaining title to the following improvements located on the above described props
erty, to wit: y

Grantors covenant and agree to remove.the above described improvements from said land
by - , 19 - ,.subject, however, to such extensions of time
as may be granted by the State in writing; and if, for any reason, Grantors fail or
refuse to remove same within' said -period of.,time prescribed, then, without any further
consideration, the title to all or any -part of such improvements not so removed shall
pass to and vest in the State.of Texas forever.
Grantors reserve all of the oil, gas and sulphur in and under the land herein conveyed
but waive all rights of ingress and egress to the surface thereof for the purpose of .
exploring, developing, mining or drilling for same; however, nothing in this reserva-
tion shall affect the title and rights of the State to take and use all other minerals
and materials thereon, therein and thereunder.

.HAVE AND TO HOLD the above described premises herein conveyed together with all and
.angular the rights and appurtenances thereto in anywise belonging, unto the State of
Texas and its assigns forever•, and Grantors do hereby bind ourselves, our heirs, executors.,
administrators, successors and assigns, to Warrant and Forever Defend all and singular
the said premises herein conveyed unto the State of Texas and its assigns against every
person whomsoever lawfully claiming or to claim the same or any part thereof.
