RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed
to execute a Quitclaim Deed with associated documents for and on behalf of the City of
Lubbock with Margaret Simon Lutherer. Said agreements are attached hereto and
incorporated in this Resolution as if fully set forth herein and shall be included in the
minutes of the Council.
Passed by the City Council this 14th day of Mav 1998.

QUITCLAIM DEED
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF LUBBOCK
THAT the CITY OF LUBBOM a Home Rule Municipality in the County of
Lubbock, State of Texas, hereinafter called "GRANTOR," for and in consideration of the
sum of TEN AND NO/100 DOLLARS ($10.00) and other good and valuable
consideration to GRANTOR in hand paid by MARGARET SIMON LUTHERER,
hereinafter called "GRANTEE," the receipt of which is hereby acknowledged, does hereby
by these presents ABANDON, DISCLAIM, RELEASE and FOREVER QUITCLAIM
unto the said GRANTEE, all of GRANTOR'S rights, title and interest in and to that
certain tract or parcel of land lying and being situated in the County of Lubbock, State of
Texas, described as follows, to -wit:
A portion of Lot 42, Block 22, Myrtle Slaton Addition Number 4, an addition to
the City of Lubbock, Lubbock County, Texas, lying West of the proposed West
right-of-way line of Indiana Avenue and further described as follows:
BEGINNING at a 1/2" iron rod set at the Northwest corner of said Lot 42
for the Northwest corner of this tract;
THENCE N. 89059'10" E., along the North line of said Lot 42, a distance
of 49.29 feet to a 1/2" iron rod set in said right-of-way line for the
Northeast corner of this tract;
THENCE S. 0°37'22" E., along said right-of-way line, a distance of 130.00
feet to a 1/2" iron rod set in the South line of said Lot 42 for the Southeast
corner of this tract;
THENCE S. 89059'10" W., along said South line, a distance of 50.71 feet
to a cross on concrete set at the Southwest corner of said Lot 42 for the
Southwest corner of this tract;
THENCE N. 0°00'00" E., along the West line of said Lot 42, a distance of
130.00 feet to the PLACE OF BEGINNING.
THE QUITCLAIM OF THE PROPERTY IS ON A "WHERE IS", "AS IS" AND
"WITH ALL FAULTS" BASIS, AND IS WITHOUT REPRESENTATION OR
WARRANTY WHATSOEVER, EXPRESSED, STATUTORY OR IMPLIED,
INCLUDING, BUT WITHOUT LIMITATION, AS TO TITLE, INCLUDING, BUT
NOT LIMITED TO THE EXISTENCE OF LIENS AGAINST THE PROPERTY, THE
DESCRIPTION, PHYSICAL AND ENVIRONMENTAL CONDITION OF THE
PROPERTY, QUALITY, VALUE, FITNESS FOR PURPOSE, MERCHANTABILITY,
OR OTHERWISE.
TO HAVE AND TO HOLD the same premises together with all and singular the
rights, privileges and appurtenances thereto in any manner belonging unto the said
GRANTEE, her heirs and assigns forever, so that neither the GRANTOR, its successors
or assigns, nor any persons claiming under GRANTOR shall at any time hereafter have,
claim or demand any right to the title to the aforesaid premises or appurtenances or any
part thereof.
