TURNER MAYOR LONNIE F. HOLLINGSWORTH MAYOR PRO TEM JACK E. BAKER ) DR. BRYCE CAMPBELL ) COUNCILMEN CAROLYN JORDAN ) and LAVENLA LOWE CITY SECRETARY and NORMAN B. McCULLOUGH, CITY MANAGER also being present; and with the following absent: none constituting a quorum: at which time the following, among other business was transacted, to wit: Councilman Baker intruduced the following resolution: "A RESOLUTION. -by the City Council of the City of Lubbock, Texas, authorizing and instructing the Mayor to publish notice of the City's intention to receive bids for the purpose of making per- manent public improvements, to wit: the paying of a portion of the cost of furnishing all plant, labor, materials, and equipment and the performing of all work required for constructing and equipping a Civic Center to be known asMemorial Civic Center, and of the City's intention to issue Certificates of Obligation to pay a portion of the contract price supplementing available funds by the amount needed for -the contractual obligation the City will assume. 6 , No Text A RESOLUTION by the City Council of the City of Lubbock, Texas, authorizing and instructing the Mayor to publish notice of the City's intention to receive bids for the purpose of making permanent public improvements, to wit: the paying of a portion of the cost of furnish- ing all plant, labor, materials, and equipment and the performing of all work required for constructing and equipping a Civic Center to be known as Memorial Civic Center, and of the City's intention to issue Certificates of Obligation to pay a portion of the contract price supplementing available funds by the amount needed for the contractual obligation the City will assume.. WHEREAS, the City of Lubbock, Texas, has heretofore held an election on the 8th day of August, 1970, and was authorized and empowered to issue $7,800,000 in bonds for the purpose of making permanent public improvements, to wit: constructing and equipping a Civic Center to be known as Memorial Civic Center, and the acquisition of a site therefor; and it now appears that the bond proceeds will not° be sufficient to accomplish the project as approved by those who participated at the . aforesaid election; and, WHEREAS, this City Council has determined that It is to the best interest of the City and its inhabitants to pay contractual obligations of the City incurred for the purpose of making permanent public improve- ments, to wit: the paying of a portion of the cost of furnishing all plant, labor, materials, and equipment and the performing of all work required for constructing and equipping a Civic Center to be known as Memorial Civic Center, and it is now proper to provide for the issuance of a notice of the City's intention to receive bids, and of the City's intention to issue certificates of obligation in payment of a portion of the contract price; and, WHEREAS, the plans, specifications, form of contract documents and minimum wage rates have been reviewed and found to be satisfactory to this governing body, and are on file in the office of the City Secretary where they may be examined without charge; and, WHEREAS, the Texas Legislature, at its last session, amended The Certificate of Obligation Act of 1971 by adding a new section 8a, which requires the giving of notice of intention to issue Certificates of Obligation prior to the authorization of the issuance of such certifi- cates, and it is the intention of this governing body to deliver certifi- cates to pay a portion of the contract price supplementing available funds by the amount needed for the contractual obligations the City will assume, and it is now proper for this governing body to provide for the issuance of such notice; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1: The plans, specifications and contract documents upon which competitive bids are to be received to pay contractual obligations of the City incurred for the purpose of making permanent public improve- ments, to wit: the paying of a portion of the cost of furnishing all plant, labor, materials, and equipment and the performing of all work required for constructing and equipping a Civic Center to be known as Memorial Civic Center are hereby approved. The notice to bidders sub- stantially in the form set forth in said contract documents (attached hereto as Exhibit A for identification purposes and made a part for all purposes) shall be published once a week for two consecutive weeks in a newspaper of general circulation in the City, the first publication to be at least fourteen (14) days prior to the date set for the receipt of bids. In accordance with said notice, this governing body shall convene at the time and place indicated therein for the purpose of letting a contract or rejecting bids and authorizing the issuance and delivery of Certificates of Obligation. SECTION 2: Further orders are reserved until such time as the . bids have been received, tabulated and presented to this governing body as set forth in said notice to bidders. SECTION 3: That the Mayor of said City be, and he is hereby authorized and Instructed to do all things necessary to cause to be Issued a notice in substantially the form attached hereto as Exhibit A. PASSED AND APPROVED, this the 13th day of, December, 1973• Mayor, City of Lubbock, Texas ATTEST: City Secretary, City of Lubbock, Texas CONTRACT DOCUMENTS, including Drawings and Technical Specifications are on file at the office of The Architects Group, 1611 Avenue M, Suite 108, Lubbock, Texas 79401. COPIES OF THE Contract Documents Part I may be obtained by depositing One Hundred Dollars ($100.00) in the name of the City of Lubbock, Texas, for each set of documents so obtained. Each such deposit will be refun- ded if the documents are returned in good condition within ten (10) days after Bid Opening. General Construction bidders will be limited to ten (10) sets. Request for copies of the Contract Documents, except General Construction bidders, will not be considered. GENERAL CONSTRUCTION BIDDERS will be required to furnish the names of the Mechanical Work, Electrical Work and Elevator Work subcontractors whom the General Construction Contractor proposes to use, along with the amount of their respective bids. GENERAL CONSTRUCTION BIDDERS must submit a certified check or bank draft, payable to the order of the City of Lubbock, Texas, negotiable U.S. Govern- ment Bonds (at par value), or a satisfactory Bid Bond executed by the Bidder and an acceptable surety, in an amount equal to five percent (5%) of the total Bid for Part I - Lubbock Memorial Center, as a guarantee that the Bidder will enter into a contract within ten (10) days after notice of award of contract to him. Bids without check, negotiable bond or Bid Bond will not be considered. THE SUCCESSFUL GENERAL CONSTRUCTION BIDDER must furnish a payment bond and performance bond, upon the forms provided, in the amount of one hun- dred percent (100%) of the contract price for PART I - LUBBOCK MEMORIAL CENTER including Mechanical, Electrical and Elevator Work, from an approv- ed Surety Company holding a permit from the State of Texas to act as Surety, or other Surety or Sureties acceptable to the City of Lubbock, Texas. ATTENTION IS CALLED to the fact that not less than the minimum salaries and wages set forth in the Contract Documents must be paid on this Pro- ject, and that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, color, sex, religion or natural origin. BIDS MAY BE HELD by the City of Lubbock, Texas, for a period not to exceed ten (10) calendar days from the date of the opening of the General Construc-. tion bids for the purpose of reviewing the Bids and investigating the qualifications of the Bidders prior to awarding the Contract. 2 Exhibit A INVITATION FOR BIDS PART I - LUBBOCK MEMORIAL CENTER NOTICE TO BIDDERS OF CITY'S INTENTION TO LET CONTRACT OR CONTRACTS FOR CONSTRUCTING AND EQUIPPING A CIVIC CENTER AND OF THE CITY'S INTENTION TO ISSUE CERTIFICATES OF OBLIGATION IN PAYMENT OF A PORTION OF THE CONTRACT PRICE SEALED PROPOSALS, addressed to the Mayor and the 07ity of Lubbock, Texas, will be received at the Office of the City Purchasing Agent, Room 207, City Hall, loth Street at Texas Avenue, Lubbock, Texas, for the construc- tion of permanent public improvements, to wit: the furnishing of all plant, labor, materials and equipment and the performing of all work required for constructing and equipping a civic center to be known as Lubbock Memorial Center (sometimes hereinafter called the Project). THE PROJECT consists of three parts. Part I is the Lubbock Memorial Center and Parts II and III are the Memorial Center Complex, Urban Renewal Project, Tex. R-138(c). All of Parts I, II and III of the Pro- ject are to be bid and constructed as a combined project. SEALED BIDS for General Construction, including mechanical work, elec- tricai work and elevator work for construction of PART I - LUBBOCK MEMORIAL CENTER will be received until 12:00 Noon, Central Standard Time, January 18, 1974. ON THE bid date mentioned, all proposals will be publicly opened and read aloud in the Council Chamber Room of the City Hall, Lubbock, Texas, and will then be immediately referred to the City's architect for tabu- lation, checking and evaluation. Final award of the contract or contracts to be entered into as the result of this notice to bidders will be made at 12:00 Noon, on the 21st day of January, 1974,:by the -City Council, convened at its regular meeting place in the City Hall. BIDS ARE INVITED upon several items and major quantities of work for Part I described fully in the Drawings and Technical Specifications and approximately described as follows: PART I ITEMS: CONVENTION COMPLEX Consisting of Banquet Hall, Exhibit Hall, Meeting Rooms, Theater, and other special purpose areas, and including stairways, elevators, _air conditioning, landscaping, lighting and site development. II CENTRAL PLANT A separate power plant to serve the entire Memorial Center Complex,. including a Central Library facility on the site. l SEALED BIDS for General Construction, including mechanical, electrical and elevator work, shall bear a notation in the lower left hand corner of the envelope that contains the Bid proposal stating that a Bid is contained therein on "General Construction on PART I - Lubbock Memorial Center and Project Improvements, PARTS II and IIi, Memorial Center Com Flex, Urban Renewal Project Tex. -13 c ." PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS may be examined without charge at the Office of the Purchasing Agent, City Hall, Lubbock,.Texas, or at the office of The Architects Group at the address hereinabove mentioned. e ON THE DATE AND TIME set for the awarding of the contract (in Paragraph 4 of this Notice) the City proposes to authorize the issuance of Certi- ficates of Obligation (payable from taxation) in the maximum principal . amount of $3,500,000 in payment of all or a portion of the contract price and the contractural obligation the City will assume. Certificates of Obligation up to such principal amount will supplement proceeds of bonds heretofore issued and sold. The successful bidder will be required to accept such Certificates in payment of all or a portion of the contract price or assign such Certificates to the party with whom the City has made provision for the Contractor to sell and assign such Certificates at their face value (no accrued interest), and each Bidder shall be required to elect on the bid form whether he will accept or assign such Certificates. i IN CASE OF AMBIGUITY or lack of clarity in stating the contract price, the City reserves the right to consider the most advantageous construc- tion thereof or to reject the Bid.
