RESOLUTION
RESOLUTION APPROVING AND ADOPTING ESTIMATE OF THE COST OF OMPROVEMENTS,
OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS IN THE NATURE OF GRADING, LAYING
CURB AND GUTTER AND PAVING PORTIONS OF CERTAIN STREETS, HIGHWAYS, AVENUES AND/
OR ALLEYS IN THE CITY OF LUBBOCK$ TEXAS AND CERTAIN STREETS AND HIGHWAYS, AVE-
NUES AND/OR ALLEYS ALONG THE BOUNDARY OF SAID CITY, FIXING THE TIME AND PLACE
FOR A HEARING TO THE OWNERS OF ABUTTING PROPERTY. RAILWAYS, OR RAILWAY COMPANIES
USING, OCCUPYING OR CROSSING ANY PORTION OF STREETS AND/OR ALLEYS AND OTHER
PERSONS INTERESTED IN SAID PROPERTY AND DIRECTING THE CITY SECRETARY TO PUBLIS
NOTICE ON BEHALF OF THE GOVERNING BODY OF THE CITY OF LUBBOCK, TEXAS.
WHEREAS, the Governing Body of the City of Lubbock has heretofore ordered
that portions of streets, highways, avenues and/or alleys be improved by grad-
ing, installing concrete curb and gutter, reinforced concrete five (5) inch
thick alley pavement, reinforced concrete rail toad caoossi ngs and street pave-
ment with cal i the base and four (4) course asphalt surface together with in-
cidentals and appurtenances.
WHEREAS, the Governing Body of the City of Lubbock has caused the City
Engineer to prepare and file estimates of the cost of such improvements and
estimates of the amounts per front foot to be assessed against abutting property
and the owners thereof, and Railways or Railway Companies using, occupying or
crossing any portion of streets and/or alleys, and such estimates have been
prepared and examined;
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
TEXAS.
Such estimates be and they are hereby adopted and approved.

TO THE OWNERS OF PROPERTY ABUTTING UPON THE HEREINBELOW MENTIONED PORTION
OF STREETS, HIGHWAYS, AVENUES AND/OR ALLEYS, RAILWAYS AND/OR RAILWAY COMPANIES
USING, OCCUPYING OR CROSSING ANY PORTION OF STREETS AND/OR ALLEYS AND TO ALL
OTHERS AFFECTED:
The Governing Body of the City of Lubbock has heretofore ordered that the
following portions of streets, highways, avenues and/or alleys in and along th
boundary of the said City of Lubbock, Texas, be improved by raising, grading
and filling and installing concrete curbs and gutters, reinforced concrete
five (5) inch thick alley pavement, reinforced concrete railroad crossings and
street pavement with caliche base, four (4) course asphalt surface, storm
sewers and drains where necessary on streets, highways, avenues and/or alleys,
designated below:
UNIT 2230 - (42 Foot Widths)
Sub -Unit 1, East half of Bangor Avenue from 58th Street to 425 feet Nor
f 58th Street, the estimated cost of Sub -Unit 1 of Unit 2230 is $4,797.01.
Sub -Unit 2, Elgin Avenue from 76th Street to 82nd Street, the estimated
t of Sub -Unit 2 of Unit 2230 is $40,808.07.
UNIT 2231 - (44 Foot Widths)
Sub -Unit 1, Frankford Avenue from 34th Street to 36th Street, the
estimated cost of Sub -Unit 1 of Unit 2231 is $16,681.55.
Sub -Unit 2, East half of Frankford Avenue from 50th Street to 49th Stree
the estimated cost of Sub -Unit 2 of Unit 2231 is $6,633.37.
Sub -Unit 3, Frankford Avenue from 36th Street to 106.4 feet South of the
South Property Line of 41st Street, the estimated cost of Sub -Unit 3 of Unit
2231 is $26,264.76.
The following fifty-two (52) foot width streets are known and designated
as Unit Number 2232, Sub -Units 1 and 2; the total estimated cost of the im-
provements is $31,103.95; the estimated amount per foot to be assessed against
the abutting property and the owners thereof for curb and gutter is 2.86; the
estimated amount per foot to be assessed against the abutting property and the
owners thereof for improvements exclusive of property owner burb and gutter is
$6.60 for front abutting property in residential zones and $4.40 for side abut
ing property in residential zones and $9.02 for business zones.
The estimated cost of each Sub -Unit is as follows:
Sub -Unit 1, East 52nd Street from Avenue "A" to Birch Avenue, the cost o
ub-Unit 1 of Unit 2232 is $9,875.26.
Sub -Unit 2, Locust Avenue from 34th Street to 36th Street, the estimated
ost of Sub -Unit 2 of Unit 2232 is $21,228.69.
The following eighty-six (86) foot width streets are known and designated
s Unit Number 2233, Sub -Units 1 and 2; the total estimated cost of the improve
ents is $182,890.88; the estimated amount per foot to be assessed against the
butting property and the owners thereof for curb and gutter is 3.41 where
lack base is used for base material and 2.86 where caliche is used for base
aterial; the estimated amount per foot to be assessed against the abutting
roperty and the owners thereof for improvements exclusive of curb and gutter
s $9.66 for front abutting property in residential zones and $6.45 for side

The estimated cost of each Sub -Unit is as follows
UNIT 2233 - (86 Foot Widths)
Sub -Unit 1, University Avenue from 82nd Street to 164 feet North of 76t
It is hereby found and determined that the cost of the improvements on
such portions of said streets, avenues, highways and/or alleys with the amount
or amounts per front foot proposed to be assessed for such improvements agains
the abutting property, the owners thereof, on the portions of said streets,
avenues, highways, and/or alleys and railways and/or railway companies, using,
occupying or crossing any portion of said streets, avenues, highways and/or
alleys as follows, to -wit:
The following streets are known and designated as Unit Number 2229,
Sub -Units 10-16, 18; Unit Number 2230, Sub -Units 1 & 2; and Unit Number
2231, Sub -Units 1, 2, and 3 (inclusive). The total estimated cost of the
improvements on Unit 2229 is $143,984.33, on Unit 2230 is $45,605.08, and
on Unit 2231 is $49,579.68. The estimated amount per foot to be assessed
against the abutting property and the owners thereof for curb and gutter is
$2.86; the estimated amount per foot to be assessed against the, abutting
property and owners thereof for improvements exclusive of property owner
curb and gutter is $6.60 for front abutting and $4.40 for side abutting
property.
The estimated amount to be assessed against the Railway Crossing and the
Railway Company for the reinforced concrete railway crossing to be constructed
between the rails and two feet on each side thereof is $3,225.85 for Sub -Unit
16 of Unit 2229.
The estimated cost of each Sub -Unit is as follows:

Sub -Unit 2, West half of Slide Road from 177 feet North of 54th Street
to 736 feet North of 54th Street, the estimated cost of Sub -Unit 2 of Unit
2233 is $5,599.39.
For the following ten (10) foot wide alleys known and designated as Unit
Number A-458, Sub -Unit 1-15 (inclusive); the total estimated cost for the
improvements is $98,811.80; the estimated amount per front foot to be assessed
against the abutting property, other than that used for siggle family or two
family residential purposes, and the owners thereof for the improvements is
$5.26; the amount to be assessed against the abutting property used for two
family residential purposes and the owners thereof and for property used for
single family purposes (where the property on both sides of the alley is used
for residential purposes) and the owners thereof is $2.93.
The estimated cost of each Sub -Unit is as follows:

Sub-Uni t 1, alley between 20th Street and 21st Street from Canton Avenue
to Boston Avenue, the estimated cost of Sub -Unit 1 of Unit A-458 is $4,061.80
Sub-tlnit 2, alley between Kenosha Drive and Knoxville Drive, from alley
South of 61st Street to 62nd Drive, the estimated cost of Sub -Unit 2, of Unit
A-458 is $5,540.94.
Sub -Unit 3, alley between 22nd Street and 23rd Street, from Gary Avenue
to Flint Avenue, the estimated cost of Sub -Unit 3 of Unit A-458 is $7,409.42.
Sub -Unit 4, alley between 62nd Drive and 63rd Drive, from Memphis Avenue
to Oxford Drive, the estimated cost of Sub -Unit 4 of Unit A-458 is $12,238.17.
Sub -Unit 5, alley between 21st Street and 22nd Street, from Gary Avenue
to Flint Avenue, the estimated cost of Sub -Unit 5 of Unit A-458 is $7,453.77.
Sub -Unit 6, alley between Belton Avenue and Boston Avenue, from 265 feet
North of 50th Street to 69 feet South of Belton Avenue on Boston Avenue, the
estimated cost of Sub -Unit 6 of Unit A-458 is $11,704.58.
Sub -Unit 7, alley between Belton Avenue and Canton Avenue, from 225 feet
orth of 50th Street to 137.9 feet South of 46th Street on Canton Avenue, the
stimated cost of Sub -Unit 7 of Unit A-458 is $11,603.08.
Sub -Unit 8, alley between 44th Street and 46th Street, from Boston Avenue
Canton Avenue, the estimated cost of Sub -Unit 8 of Unit A-458 is $5,103.88.
Sub -Unit 9, alley between 44th Street to 46th Street, from Canton Avenue
o Detroit Avenue, the estimated cost of Sub -Unit 9 of Unit A-458 is $3,492. 10.
Sub -Unit 10, alley between Boston Avenue and Canton Avenue, from 42nd
Street to Boston Avenue, the estimated cost of Sub -Unit 10 of Unit A-458 is

Sub -Unit 11, alley between 42nd Street and 43rd Street, from Canton
Avenue to Elgin Avenue, the estimated cost of Sub -Unit 11 of Unit A-458 is
$7,919.07.
Sub -Unit 12, alley between 46th Street and 48th Street, from Detroit
Avenue to 139 feet East of Detroit Avenue, the estimated cost of Sub -Unit 12
of Unit A -458 is $2,056.68.
Sub -Unit 13, alley between Canton Avenue and Elgin Avenue, from 45th
Street to 214.8 feet North of 45th Street, the estimated cost of Sub -Unit 13
of Unit A-458 is $2,807.96
Sub -Unit 14, alley between 45th Street and 48th Street, from Elgin Avenue
to 306.6 feet Southeast of Elgin Avenue, the estimated cost of Sub -Unit 14 of
Unit,A-458 is $3,349.74.
Sub -Unit 15, alley between 43rd Street and 45th Street, from Elgin Avenue
to 300 feet East of Elgin Avenue, the estimated cost of Sub -Unit 15 of Unit
A-458 is $4,979.01.
And arrangements for the making and construction of such improvements
with pavement of four course asphalt surface treatment (Inverted Penetration
Type) and a six (6) inch compacted caliche base in streets, highways and
avenues, alleys to be constructed with pavement of five (5) inch reinforced
concrete slab has been made and entered into by the City of Lubbock, Texas and
rolls or statements showing the proposed amountst:t4bobe assessed against the
abutting property, the owners thereof and the Railways and/or Railway Companies
using, occupying or.crossing any portion of said streets or alleys, their rails
tracks, double tracks, turnouts and switches and two (2) feet on each side
thereof for reinforced concrete street crossings and reinforced concrete alley
slabs in said streets or alleys have been filed with the City, such rolls or
statements showing other matters and things, and have been approved and the
City Council of said City has fixed a time and place for hearing to the owners
of property abutting upon said portions of streets, highways, avenues and/or
alleys and Railway or Railway Companies using, occupying or crossing any
portion of said streets or alleys, and to all others affected „ at which hearing
the amounts to be assessed against the respective parcels of abutting land and
the owners thereof for improvements in the units upon which the particular
parcels of property abut, the amounts of benefits to the respective parcels of
property by means of the improvements in the unit upon which the particular
property abuts, the regularity of the proceedings with reference to such
improvements, the apportionment of the cost of such improvements, and other
matters and things wi 1 1 be determined, and after such hearings assessments wi l l
by ordinance be made and levied, and such hearing will be had and held by and
before the City Council of the City of Lubbock, Texas in regular Council Meet-
ing Room in the City Hall, in the City of Lubbock, Texas on the 24th day of
January, 1974 at 2:00 p.m. o clock. The rolls or statements showing the
proposed amounts of such assessments are on file in the office of the City
Secretary and copies thereof are in the office of the City Engineer of the
City of Lubbock and open to inspection of any interested parties at any time,
and of all said matters and things all such owners of propprty, as well as
any and others in anywise affected or interested, will take due notice.
By order of the Ci ty Counci 1 of the Ci ty of Lubbock, this the l3th day of
December, 1973.
No notice other than that herein provided for shall be necessary and such
notice shall be due and sufficient notice to any and all persons, firms,
corporations and other parties.
That a hearing be given and held by and before the Governing Body of the
City of Lubbock, Texas, to all persons owning or claiming any property abuttin4
any part or portion of said streets, highways, avenues and/or alleys or any
Railway or Railway Company using, occupying or crossing any street, avenue or
alley described in Section II, of this Resolution, as well as all owning or
claiming any interest in any such property. Such hearing shall be given and

directed to give notice of the time and place of such hearing, and of other
atters and facts in accordance with the terms and provisions of an Act passed
t. the first called seddion of the 40th Legislature of the State of Texas and
nown as Chapte'r 106 of the Acts of said. Legislature which has been adopted as
n amendment to and made a part of the Charter of the City of Lubbock, Texas,
nd as amended by'Chapter 176 Acts of the 60th Regular Session of said
egislature. Such notice shall be by advertisement inserted at least three
Ames in a newspaper published in the City of Lubbock, Texas; the first
ublication shall be made at least twenty-one days before the said 'nearing;
and, additional written notice of the hearing shall be given by depositing in
he United States mail, at least fourteen (14) days before the date of the
earing, written noticeof such hearing, postage prepaid, in an envelope
ddressed to the owners of the respective properties abutting such highway,
ighways, or portion or portions hereof and any railway or street railway using
ccupying or crossing any highway, portion or portions thereof to be improved,
s the names of such owners are shown on the then current rendered tax rolls
f the City of Lubbock and at the addresses so shown, or if the names of such
espective owners do not appear on such rendered tax rolls, then addressed to
uch owners as their names are shown on the current unrendered rolls of the
i ty at the addresses ;;shimn thereon. Said notice shall comply with and be in
ccordance with the terms and provisions of this resolution and said Act as
mended.
