RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock, Supplemental
Agreement Number 3 for the development of the West Texas Disposal Facility, by
and between the City of Lubbock and HDR Engineering, Inc. and related documents.
Said supplemental. agreement is attached hereto and incorporated in this resolution as
if fully set forth herein and shall be included in the minutes of the City Council.
Passed by the City Council this 26th day of March 1998.

Additional Services for Design, Bid, and Construction
West Texas Region Disposal Facility
Dear Ms. Cox:
HDR Engineering, Inc. (HDR) and Parkhill, Smith and Cooper (PSC) are pleased to
resubmit this contract amendment for professional engineering services related to the
development of the West Texas Region Disposal Facility. These services represent the
additional support required during the facility design and bid services phases of the
project and anticipate the testing services during the construction phase. Please note
the following additional services:
1. Phase Two was modified to redesign the access road alignment and relocate the
maintenance and gate house facilities.
2. Phase Two was also modified to include two permit modification requests.
3. Phase Three was modified to extend the bid services timeframe.
4. Phase Four was modified to include the fees for geotechnical foundation testing,
monitor well and gas probe surveying, monitor well and gas probe installation, water
well rehabilitation, and construction testing services.
If this contract amendment is acceptable to the City, please arrange for the execution of
all appropriate number of copies and return two executed originals to HDR. Thank you
for the opportunity to further assist you in bringing the West Texas Region Disposal
Facility into operation. We look forward to hearing from you at your earliest
convenience regarding this contract amendment. Please contact us if we can assist

THIS SUPPLEMENTAL AGREEMENT NO.3, made as of March 26 , 1998 between
the City of Lubbock, Texas and HDR Engineering, Inc. for modifications to the
AGREEMENT BETWEEN CITY OF LUBBOCK, TEXAS AND HDR ENGINEERING,
INC. FOR PROFESSIONAL ENGINEERING SERVICES dated October 8, 1992.
OWNER and ENGINEER, in consideration of the mutual covenants contained herein,
agree to modifications to the agreement as follows:

PART V - CONSTRUCTION DOCUMENTS AND SERVICES
OBJECTIVE OF THE PROJECT
The following Scope of Services represents a contract amendment to the City of
Lubbock for engineering and related services associated with the design and
construction of the West Texas Region Disposal Facility. Our purpose is to provide
those services required to advance the approved permit -level design through the point
of opening the facility for waste disposal operations in accordance with the Project
schedule.
We propose to implement this project by providing the following professional services.
PHASE ONE - CONCEPTUAL DESIGN

PHASE TWO - DETAILED DESIGN (PLANS AND SPECIFICATIONS)
OBJECTIVE
To develop plans and specifications for each of the landfill facilities (roads, buildings
and disposal cells) identified in the conceptual design and to coordinate the Texas
Natural Resources Conservation Commission (TNRCC), Texas Department of
Transportation (TxDOT) and Texas Department of Licensing and Regulation Agency
(Agency) approval of these plans.
Task One - Detailed Design Of Roads and Utilities
Activities
The HDR Team will prepare drawings showing the design details for construction of an
access road, replacement water well and utility crossings. Access roads will include
improvements to access roads off -site (to include the deceleration and turning lane
from the State highway) and interior roads from the public roadway to the first cell in the
landfill development sequence. The HDR Team will also include in the detailed design,
access to scale facilities, gate house, office, maintenance facilities, wash rack, refueling
station, groundwater monitoring wells, gas probes and any other ancillary facilities
identified in the conceptual design.

The HDR Team will prepare documentation to support two separate permit modification
submittals to the TNRCC and work with the TNRCC to secure the approval of these
submittals.

PHASE THREE - BID ADMINISTRATION
OBJECTIVE
To support the City in identifying and contracting with a qualified landfill construction
contractor.

This Task was modified to provide for the HDR Team assisting the City during the bid
process that was extended over a five month period ( two months longer than was
originally anticipated).

PHASE FOUR - CONSTRUCTION SERVICES
OBJECTIVES
To provide the City with an environmentally secure landfill disposal cell (Cell 1A), built in
accordance with the construction plans, and the facilities to support the landfill
operation.

Activities
This Task is modified to include the fees for the construction testing services including
the preliminary foundation geotechnical testing.

This Task is modified to include the fees for surveying and installing the monitor wells
and gas probes. In addition, fees are included to rehabilitate the facility water well.

PROFESSIONAL SERVICE FEES
We propose that the original compensation plan, outlined in Supplemental Agreement
No. 2 be modified to address the additional scope of services outlined above. This
compensation will continue to be invoiced on a per diem basis. The Phase One,
Conceptual Plan was completed within the estimated fee of Thirty -Seven Thousand Six
Hundred and Seventy -Seven Dollars ($37,677) and no change is proposed in this fee.
Phase Two development the Construction Plans and Specifications, as modified above,
will require an additional fee of Thirty -Two Thousand Nine Hundred and fifteen Dollars
($32,915) for a total fee of One Hundred Ninety -Seven Thousand Four Hundred and
Fifty -Four Dollars ($197,454). Phase Three, the Bid Services, as modified above, will
require an additional Fourteen Thousand Dollars ($14,000) for a total fee of Thirty -Four
Thousand Three Hundred and Fifty -Four Dollars ($34,354). Phase Four, covering the
Construction Services including the additional services identified above, can be
completed for an estimated fee of Three Hundred Fifty -Eight Thousand Six Hundred
Twelve Dollars ($358,612). The total, revised, not -to -exceed project budget is Six

Hundred Twenty -Eight Thousand Ninety -Seven Dollars ($628,097) without further City
authorization. Invoices will continue to be submitted monthly and will include a project
progress report, anticipated effort for the next month and a comparison of the project
per cent complete versus the per cent of fee invoiced. The labor charges for this
project will be calculated based the salaries of individuals and the time they actually
work on the project, multiplied by a factor for overhead and profit. Expenses will be
invoiced as outlined in the original contract with fees for sub -contractors representing a
direct pass through expense.
Except as modified herein, all other provisions of the Agreement remain unchanged.
IN WITNESS WHEREOF, the parties have executed this supplemental Agreement as
of the day and year first written above.
