TURNER, MAYOR 11ATTEST: Lavenia Lowe, City Secretary -Treasurer !APPROVED AS TO FORM: Fred O, Senter, Jr., ity Attorney i �I j 4 I I I, p b FIRE PROTECTION AGREEMENT THE STATE OF TEXAS 1 KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK THIS Agreement entered into between the Commissioner's Court of Lubbock County, Texas, acting by and through its duly authorized County Judge, hereinafter called "County" and the City of Lubbock, acting by and through its duly authorized Mayor, hereinafter called "City". WITNESSETH: WHEREAS, the County Commissioner's Court of Lubbock County, Texas, has determined that a need exists for fire protection to be provided to protect the property of citizens of Lubbock County, Texas, who reside outside the limits of the City of Lubbock; and, WHEREAS, the City of Lubbock agrees to furnish fire protection service upon the terms and conditions stated below: 1. The City agrees that fire fighting equipment shall be furnished in response to fire calls from points beyond the limits of the City and such fire fighting equipment as shall be determined by the Fire Chief or such officer as he directs, shall be dispatched to the fire. 2. The County agrees that it shall pay to the City the sum of TWO HUNDRED SIXTY-SEVEN AND 50/100 ($267. 50) DOLLARS for the City's res- ponding to each call for fire assistance at a location beyond the City limits. The County further agrees that payment of any obligation arising out of this Agreement shall be made by the County from current revenues of the County of Lubbock or from a fund established by the County and within the immediate control of the County. 3. The Fire Chief of the City of Lubbock or his designated employee shall make or cause to make a fire report showing the date, time, location and description of burning structures and his estimate of property damage of each fire call made beyond the limits of the City and shall file each report with the City auditor and forward a copy to the County auditor within seventy-two (72) hours after such fire call has been received. 4. The County hereby covenants and agrees to save and hold the City harm- less from any and all costs, damages, liabilities, or claims of any nature what- soever which accrue or arise out of furnishing such fire protection. 5. It is understood and agreed that the Agreement for fire service shall cover only those portions of the County which are not included within incorporated cities or towns within Lubbock County, Texas. 6. It is understood and agreed that in the event an emergency condition exists within the City of Lubbock by reason of one or more fires in progress with- in the City, the Fire Chief shall determine the advisability of sending fire fighting equipment beyond the limits of the City in response to a fire beyond the limits and the judgment of the Fire Chief shall be final. 7. This Agreement shall become effective and shall extend for a period of one (1) year from and after October 1, 1973. EXECUTED this day of , 1973.
