HomeMy WebLinkAboutResolution - 5753 - Interlocal Cooperative Agreement - City Of New Deal - 01_22_1998RESOLUTION N0. 5753 Item #39 January 22, 1998 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Cooperative Agreement by and between the City of Lubbock and the City of New Deal and all related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. An-, ATTEST: Kayttparnell, City Secretary `---- APPROVED AS TO CONTENT: V2,Cq; Bob Cass, City Manager APPROVED AS TO FORM: ccdocs/lanuary 13, 1998 12/18/97 THU 14:08 FAX 8067753307 CITY ATTORNEY 0 002 RESOLUTION N05753 Item #39 January 22, 1998 RESOLUTION173 INTERLOCAL COOPERATIVE AGREEMENT BY AND BETWEEN THE Cli'fY OF LUBBOCK AND THE CITY OF NEW DEAL This Agreement entered into this 22 day of December . 1997, by and between the CITY OF LUBBOCK, a Texas Home R e Municipal Corporation (hereinafter called "City of Lubbock") and the CTfY OF NEW DEAL, a Texas Municipal Corporation, (hereinafter called City of Tulia"). WIiEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico. Canada, and the United States; and WHEREAS, the establishment of the Corridor through the West Texas area could promote economic development for the cities and counties of this area; and WHEREAS, it is necessary to employ an engineering firm to conduct a study (hereinafter called "the Study") to survey the feasibility of establishing the Corridor; and WHEREAS, the parties desire to investigate the feasibilty of establishing the Corridor and are willing to fund the Study and any associated administrative expenses. NOW THEREFORE, it is agreed between the pasties hereto that: 1. SCOPE OF SERVICE A. City of New Deal Responsibilities: City of New Deal agrees topay $ 284.01 which is its proportional share of the expenses by population for the y uy ew Deal agrees that said funds nisy be used for the fimdin of the Study and any or all operational costs or administrative expenses incurred by the City of Lubbock in implementing and administering the Study and incurred in the lobbying for or the promotion of the Corridor. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also find its proportional share of funding the Study and other related expenses. IL GENERAL CONDITIONS A. Term The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement tnay be renewed or extended as may be necessary. B. Responsibility The party-'s shall be responsible for their own respective claims, actions. suits, charges and 0- • whatsoever that arise out of their respective performance or nonpenceof the subject matter called for under this Agreement. 12/18/97 MT 14:09 FAX 8067753307 CITY ATTORNEY IZ003 C. Amendments City of Lubbock or City of New Deal may amend this agreement at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both organizations and approved by the City of Lubbock Council or City of New Deal City Council if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or City of New Deal from its obligations under this Agreement. D. Revenues The parties agree hereto that all payments made pursuant to this Agreement must be made from current revenues available to each respective party. All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special ro ect fund in the City of Lubbock's general mule se account. The City of Lub agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for City of New Deal's review- E.
