HomeMy WebLinkAboutResolution - 021154B - Paving Release - Frank Hyder - Lot 7, Block 6, Wheelock 2Nd Addition - 02_11_1954 OVA RESOLUTION i WHEREAS, the City Commission has heretofore passed Ordinance No. 917 din June 9, 1949, which Ordinance levied and 'assessed various properties in the City n of Lubbock certain specified amounts for street improvement purposes; and U 1C WHILREA.S, such Ordinance was filed in the Deed Records of Lubbock County, Texas on the 15th day of June, 1949, in Volume 391, page 6, constituting an apparent lien on certain property in a portion of Faving .Unit 919 covering Birch Avenue from East 19th Street to East 26th Street which certain property being Lot Seven (7), Block Six (6), Wheelock Second Addition to the City of 7 Lubbock Texas was assessed 4183.72 in the name o£ Frank Hyder and 1rE cG? , WHEREAS, such paving on Birch Avenue from East 24th Street to East 25th Street, as intended to be made, has in fact not been made nor assessment levied T.�E�,1 by virtue of such Ordinance and there is no intent in the immediate future plans o ar the City for such paving, and from the further fact that the owner of such property has requested and is desirous of obtaining a release on all such property (?med by such individual in such lot and block abovementioned from the apparent lien created by such Ordinance abovementioned; N&d, THEREFORE, BE IT RESOLVED BY THE CITY COMAISSLON OF THE- CITY OF LUBBOCK: Section 1. THAT, the Mayor BE, and he is hereby authorized and directed to execute a Reuel-ease on all that hereinafter described property in Wheelock Second Addition, an addition to the City of Lubbock, Lubbock County, Texas releasing any cloud of title or apparent lien created by virtue: of Ordinance No. 917 insofar as it affect tot 7, Block 6, Wheelock Second Addition by virtue of a notice of intention to pav that property abutting such described property on Birch Avenue, such release being made in favor of one Frank Hyder, in whose name the property was assessed in such Ordinance on all that property lying and being situated in Lubbock, Lubbock County, Texas and being further described as follows, to-wit: Lot 7, Block 6, Wheelock Second Addition, an Addition to the City of Lubbock, Lubbock County, Texas Section 2. THAT, such release is to contain the provision that such release does not in any way affect any property or liens not specifically described therein as being released, and that all liens and apparent liens against property owners not otherwise released being expressly retained in such release. RELEASE TIM STATE OF TBZAS COUFTY OF LUBBOCK ' IMMAS, heretofore on the 15th day of June, 1949, the City of Lubbock filed its Ordinance go, 917 in the Deed Pecords of Lubbock County, Texas, such instrument being recorded in Volume 391, page 6 of the Deed Records of Lubbock County, Tent, euc Ordinance containing a notice of improvements and an apportionment of the cost of eh'improvemente by assessing a lien upon the property abutting thereon.; and, WHER&. S, in such assessment Ordinance there was included Lot 7, Block 6, Wheelock Second Addition, Lubbock, Lubbock County, Texas on which property the amount of 083.72 apportionment constitutes a cloud and apparent lien against such property for paving which was proposed on Birch Avenue abutting such property; and, MEREAS, said notice of improvement in fact has created no lien against the property hereinafter described by reason of the notice of improvement for the paving on Birch. Avenue for the reason that such property has not been paved and there is no Immediate plan of paving Birch Avenue abutting such property by virtue of Ordinance ho. 917, passer! June 9, 1949, and FEAM HYDER having requested such property released from, the cloud and appsrunt lien on such title; Nan, THERLTORB, M01:11 ALL Y-07 BY THESE P£E8&TS: That the CITY OF LUD OCK, acting by and through its officer duly authorised bS Resolution of the City Commission,, on the 11th day of February., 1954, in consideration of the premises and ONE and D0j100 (�1.00) DOLLARS Cash in hand paid by FHAHH HYDER to the CITY OF LUBBOM, does hereby and by these presents RELEASE, RELIKQULSH LED FOREVE11 QUITCLAIM to FRUK MER, his heirs, executors, administrators and assigns, all rig;zt, title and interest it hae in and to the following described property which has arises by virtue of such 1i6n or apparent 3dens on all such property lying and being situated in Lubbock, Lubbock County, Texas and being further described as follows, to—wits Lot 7., Block 6, Wheelock's Second Addition., an Addition to the City of Lubbock, Lubbock County, Texas This Release in no way affects any property or liens not:apecifically described , herein, and all liens and apparent liens against property owners not otherwise released are hereby expressly retr_ired. j E MMED thie_11th day of February f 1954.
