HomeMy WebLinkAboutResolution - 021154A - Regulation Over Water & Light Department Regarding Correction Of Errors - 02_11_1954 .r 101Cfpa ; SEW"- - r `'RESOLUTION Water and Light Department WHEREAS# the City Commission finds that no adequate authority exists in the Water and Light Department for timely disposition and correction of errors, the making of refunds and other adjustments necessary and incidental to the handling of such business, and the.Commission deems it proper to regulate the 41- authority and authorize the disposition of certain classes of items requiring (' daily attention and disposition; T k E R E F O. R E, BE IT RESOLVED BY THE CITY COMSSION OF THE CITY OF LUBBOCK% SECTION 1. Whenever duplicate or erroneous payments have been made to the Water and Light„Department and have been duly verified by the Department Head, he is authorized to make cash refunds not exceeding $5.00 to the person entitled to the refund and written receipt shall be required of the person to whom the refund is made, such receipt to be preserved and accounted for as required by the Finance Officer, SECTION 2. Whenever duplicate or erroneous payments have been made under conditions above stated, and the amount is more than $5.00 and does not exceed $100.00, credit memos may be issued to apply on the consumerts water and/or electric account. SECTION 3. Whenever the adjustment of a grater and/or electric account is required, by reason of over-reading of meters, .defective meters, mechanical faults in meters, or errors in billing, the Department Head, upon verification of the error, is authorized to issue a credit memo for benefit of the con- sumerts account not to exceed $100.009 otherwise the adjustment shall be sub- mitted to the City Manager for disposition. The credit memo shall state the facts justifying issuance. SECTION 4. The City Finance Officer shall prescribe forms to be used for the purposes stated in Sections 1 (One), 2 (Two) and 3 (Three), and no refund shall be made unless the error is verified by the Department Head. SECTION 5. All claims for damages to property caused by water line breaks and/or power failures shall be made in writing and itemized and',signed by claimant and filed with the Department Head and City Secretary. The department head shall investigate the claim and make written report to the City Manager for approval or disapproval according to the City's liability, if any. City Manager may authorize payment when liability, if any, is approved by City Attorney, and the amount does `not exceed Five Hundred Dollars ($500.00) . Claims exceeding $500.00 shall be submitted to the City Commission for con- sideration. SECTION 6. The authority here granted shall not be construed as apply- ing to any. other department of the City of Lubbocke 'On motion of Commissioner Davis , seconded by Commission Morris , this resolution was passed this may of EebML:i. 1954.
