RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a SALES CONTRACT
bet-Ween the City of Lubbock and the Synod of Texas of the United Presbyterian
Church of the U. S. A. attached herewith which shall be spread upon the minutes of
the Council and as spread upon the minutes of this Council shall constitute and be
a paxt of this Resolution as if fully copied herein in detail.
Passed by the City Council this 24th day of May 1973.

THE STATE OF TEXAS
SALES CONTRACT
COUNTY OF,LUBBOCK
THIS AGREEMENT made and entered into on this $4 day of
May, 1973, by and between SYNOD OF TEXAS OF THE UNITED PRESBYTERIAN
CHURCH OF THE U.S.A., herein called SELLER, and THE CITY OF LUBBOCK,
herein called BUYER;
1. TRANSACTION For the price and subject to the terms and conditions
hereinafter specified, SELLER has agreed to sell and convey to the BUYER and
BUYER has agreed to purchase from SELLER the following described property;
Being Lots One (1), Two (2), and Three (3) of Tract F,
MacKenzie Terrace Addition to the City of Lubbock,
Lubbock County, Texas, according to the map or Plat
thereof filed for record in the Office of the County Clerk
of Lubbock County, Texas. --

This conveyance is to be subject to all easements of record or that are visible
on the ground affecting this property.
2. SALES PRICE BUYER agrees to pay SELLER a total purchase price
for the above described property of $55, 000. 00 cash to be paid at the time of
closing.
-3. CONVEYANCE SELLER agrees to convey to BUYER by General War-
ranty Deed the property described in Paragraph No. 1, free and clear of all liens
and encumberances except for the easements set forth in Paragraph No. 1.
4. TITLE SELLER represents that he is vested with good and merchant-
able title to the land dealt with herein and agrees to furnish to BUYER an Owner's
Policy of Title Insurance at SELLER'S expense.
5. TAXES All ad valorem taxes and assessments shall be prorated to the
date of closing.
6. POSSESSION OF LAND SELLER agrees to deliver possession of the
land herein conveyed to BUYER at the date of closing hereof.
7. CLOSING DATE This transaction shall be closed within thirty (30) days

after Title Insurance binder is delivered to BUYER, and this agreement shall be
binding on the parties, their heirs and assigns.
