Passed by the City Council this ATTEST: etty ohnson City Secretary APPROVED AS TO CONTENT: Hertel, APPROVED AS TO FORM: A!u Harold Willard, Assistant City Attorney HW Ap/ccdocs/Releaseses Noivember 25, 1994 Id /THE STATE OF TEXAS 1 COUNTY OF LUBBOCK Resolution No. 4689 December 15, 1994 File And Re►um TO Item 1125 Ed wcy R-O-w VOL 4754PAGE278 § IOJL14 KNOW ALL MEN BY THESE PRESENTS: WHEREAS, on or about the 15th day of July, 1993, the City of Lubbock, Texas, a Home Rule Municipality, filed in the Real Property Records of the Lubbock County Courthouse Ordinance No. 9605 asserting and declaring a lien on the hereinafter described property as security for a portion of the cost of street or alley improvements abutting such property; and WHEREAS, the owner of the property for which the lien was filed has provided the City with an affidavit declaring the property to be his homestead and requested a release of lien; NOW THEREFORE, the City of Lubbock, the present legal and equitable owner and holder of the paving assessment lien filed in Volume 4263 , Pages 326-340 of the Real Property Records for Lubbock County, Texas, does hereby release, cancel, discharge and quitclaim unto JAMES BRENT TIDWELL, his heirs and assigns, the lien upon the following described property, to -wit: Lot One (1) and the East 20 feet of Lot Two (2), Block 23, Ellwood Place Addition to the City of Lubbock, Lubbock County, Texas. Nothing contained herein shall be construed as effecting a release of any personal liability of the owner of the above -described property for any assessment in connection with street or alley improvements abutting such property; nor shall this instrument be construed as effecting a release of lien for any property other than the property specifically described herein.
