HomeMy WebLinkAboutResolution - 052473B - Execution Of Proposed Neighborhood Facilities Grant Contract - HUD - 05_24_1973re. yy 66 Z05 RESOLUTION APPROVING AND PROVIDING FOR THE EXECUTION OF A PROPOSED NEIGHBORHOOD FACILITIES GRANT CONTRACT' WHEREAS, under Section 703 of the Housing and Urban Development Act of 1961 the United States of America (herein called the "Government") has tendered to City of Lubbock (herein called the "Public Body") a proposed Neighborhood Facili- ties Grant Contract under which the Government agrees to make a Grant to the Public Body to aid in financing a project, designated Project No. NFP»TX-06-»16- 100 7 and WHEREAS, the Public Body has given due consideration to said proposed Con• tract; and WHEREAS, the Public Body is duly authorized, under and pursuant to the Constitution and laws of the State of Texas, to undertake and carry out said i and to execute such proposed Contract; NOW THEREFORE BE:1_T RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: Section 1. The proposed Contract, designated "Neighborhood Facilities Grant Contract, Contract No. NFP-.TX»06-16-1007(G), " consisting of Parts I anebII, under and subject to the provisions, terms, and conditions of which the Govern- ment will make a Neighborhood Facilities Grant under Section 703 of the Housing and Urban Development Act of 1965 to the Public Body to aid in financing the cost of a project, designated Project No. NFP-TX-.06-16-1007,situated in Lubbock, Texas, is hereby in all respects approved. Section 2. The Mayor is hereby authorized and directed to exeeute said pro- posed Contract in two (2) counterparts on behalf of the Public Body, and the City Secretary -Treasurer is hereby authorized and directed W impress and attest the official seal of the Public Body on each such counterpart and to forward such counterparts to the Department of Housing and Urban Development, together with such other documents relative to the approval and execution thereof as may be required by the Government. Section 3. The Director of Parks & Recreation of this Public Body is hereby authorized to file requisitions, together with necessary supporting documents, with the Government, from time to time as Grant funds are required, requetiting payments to be made to it on accoiint of the Grant provided for in the Contract, a to do and perform all other things and acts required to be done or performed in order to obtain such payments. Section 4. The Public Body agrees to abide by all of the provisions, terms, and conditions of said Contract. _ Aii K_7- Section 5. This Resolution shall take effect this 24th day of May, 1973. The City Council of the City of Lubbock, Texas met in regular meeting at City %Hall in the City of Lubbock, at the place, hour, and date duly established for the holding,of such meeting. The Mayor called the meeting to order and on roll call the following answered present: Councilman Councilwoman Councilman Councilman Hollingsworth Jordan Baker Campbell and the following were absent: NONE The Mayor declared a quorum present. The following Resolution was introduced by Mayor Turner; read in full and considered: (Attached hereto). Councilwoman Jordan moved that the fore- going Resolution be adopted as introduced and read, which motion was seconded by Councilman Hollingsworth, and upon roll call the "Ayes" and "Nays" were as follows: AYES NAYS Hollingsworth Baker NONE Jordan Campbell The Mayor thereupon declardd said motion carried and said Resolution adopted. We are also enclosing instructions relating to the approval and execution of this Contract. Please acknowledge receipt of this letter and enclo- sures promptly. Moore Attorney Advisor Enclosures INSTRUCTIONS FOR APPROVAL AND ACCEPTANCE OF NEIGHBORHOOD FACILITIES GRANT CONTRACT Enclosed are the following documents: 1. Three separately bound, undated counterparts of the proposed Contract. 2: Three copies of a form of Resolution or Ordinance accompanied by three complete sets of minute extracts for guidance in approving ` and providing for the execution of the Contract, accompanied by three Certificates 3. One copy of a form of Opinion and Certificate to be completed by your attorney. The Contract should be either, executed or rejected, and this office notified of such execution or rejection, within 30 days from the date of this letter. If, upon receipt of this letter, it appears that you cannot meet this requirement, please communicate with us immediately, giving the reasons for the necessary delay and indicating the additional time desired Promptly after taking appropriate action on the Contract, please transmit the following documents to this office: 1. Two executed,_undated counterparts.of the Contract. The third counterpart of the Contract should not be dated and should be retained by you for your files. 2. Two copies of the resolution or ordinance as adopted, accompanied by two complete sets of minute extracts and appropriate certificates relating thereto, properly completed and signed. 3. One signed and dated opinion and certificate from your attorney. After the Contract has been executed and dated by the Government, you will be forwarded one executed counterpart for ;our records.
