Brown on all that property known as the Northwest One-fourth (NWt) of Section 5, Block E, Lubbock County, Texas, and the said 0. H: Pope is residing on such tract of land and there are no existing natural gas servicing facilities in any alley or street abutting said property; and, WHEREAS, the said 0. H. Pope is desirous of running a private natural gas pipeline from the nearest natural gas main from which the above property can be .~s-erved, and in order to run said private natural gas pipeline it will be necessary to use a portion of a public alley and streets; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COVIaSSION OF THE CITY OF LUBBOCK: SECTION 1. That, subject to the hereinafter stated terms and conditions . H. Pope be, and he is hereby granted a license to lay and construct a private natural gas pipeline situated in a portion of an alley and Avenue J and 66th Streets further described as follows: BEGINNING at the West Texas Gas ComparWts natural gas main located in the alley North of 66th Street and East of Avenue J in the City of Lubbock, Lubbock County, Texas; THENCE North across said alley to the gas meter located in the Southwest Corner of Lot 5, $lae1�.1,(One}, Circle View Addition; THENCE West to a point eight feet (81) distant from the West boundary line of Lot 5, Block 1 (One), Circle View Addition; THENCE South parallel to the East right-of-way line of Avenue J and eight feet (6t) distant therefrom and continu- ing South across 66th Street to the North line of Section 5, Block E; THENCE continuing in the Northwest One-fourth (NWT-) of Section 5, Block E to connect with an irrigation well located approximately 293 feet South of and 413 ,feet East of the point at which the said gas pipeline enters the North- westt One-fourth (NWg) of Section 5, Blot, E; It is further contemplated that a "T" joint shall run-off of such natural gas pipeline to connect with the residence of 0. H. Pope facing Avenue H, all being in the County of Lubbock, State of Texas. SECTION 2. Said Licensee shall pay to the City as compensation for said license the sum of One Dollar ($1.00) per year for the duration of said license, hick shall be for a period running from year to year, subject to the right of the Pity to cancel or revoke said license upon thirty (30) dayst notice, with or 'thout cause. SECTION 3. Licensee shall indemnify and save harmless the City from any and all claims, losses, damages and expenses of every nature which the City may incur or become liable for, resulting from the constructing, laying, and mainten- ance of said private natural,g as pipeline. SECTION 4. Licensee shall bear the entire cost of ditching and laying said pipeline and in refilling said ditch. The ditching, laying pipeline and re- laci of dirt' therein shall be done under the supervision of the City Engineer, aid 03 2(a S3 provide and erect such barricades, warning signs, and other safety devices, under the supervision and as directed by said City Engineer, and the Licensee shall pay all cost incidental to such supervision. SECTION 5. Licensee shall lay said pipeline at a minimum depth of 6ur O feet under street grade, as determined by the City Engineer, and said pipeline shall not exceed a maximum of two (2) inches in diameter. SECTION 6. At such time as the license should be cancelled or revoked, the private natural gas pipeline as laid and constructed under the license, shall be Come the property of the City of Lubbock. SECTION 7. The license and privilege granted therein shall not be transferable .9 in whole or in part, except upon written consent of the City of Lubbock in each instance. SECTION 8. The license shall grant to the said 0. H. Pope the right to transport natural gas through said pipeline for'the limited purpose of running one irrigation well and serving his� resideneo for domestic use as hereinbefore described in Section;l0 ,and shall not' be distributed or sold to ar>3r other persons or used for any other purposes than as`.herein stated on said property. Licensee shall be expressly prohibited from making any connections onto said private natural gas pipeline in accordance with said license at any point thereon except as herein otherwise stated and said pipeline shall be constructed for the sole purpose of supplying power for the existing water well and residence as hereinbeforel designated. SECTION 9. In the event any holder of a franchise to use the streets and alleys for distribution of natural gas in the City of Lubbock shall ever extend its lines along and through any alley or street abutting the above mentioned property leased by said 0. H. Pope, and said franchise holder can service said property, then in that event, the said Licensee shall, within a reasonable time thereafter, abandon the use of the private natural gas pipeline contemplated within the terms of this Resolution and License 'Agreement, and shall obtain service from such line so running through an alley or street abutting said property.
