HomeMy WebLinkAboutResolution - 102672G - Land Acquisition - Roberts & Mcwhorter Addition - 10_26_1972toe 7 `1, bus MR:kr aa� ' RESOLUTION 1-2 ' v WHEREAS, it has been determined by the City Council upon information by the Traffic Engineer that the increased traffic along a portion of Fourth Street within the City of Lubbock, Lubbock County, Texas, necessitates the widening and improving of Fourth Street; and, WHEREAS, it is necessary to acquire for street and highway right of way purposes the fee simple title to the land hereinafter described, owned by Phillips Petroleum Company; and, WHEREAS, the City Council has caused an appraisal to be made of said land and the value and total damages, if any, to the owners, and all others, whose inte: est may appear, for fee simple title to said land have been appraised in the amoun of $24, 350. 00, and the Council finds such amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acquire for the purposes of widening and improvin the public street known and described as Fourth Street, the fee simple title to the land lying and being situated in Lubbock County, Texas, and more particularly des cribed as follows, to -wit: Being 2237. 63 sq. ft. out of Lot 1, Block 12, Mayfield Subdivision of Roberts & McWhorter Additiont:) the City of Lubbock, Lubbock County, Texas, according to a plat of said Addition recorded in Volume 26, Page 52, of plat records of Lubbock County; and being the same property described in a deed from C. D. Crump, et ux, Fannie to Phillips Petroleum Company dated July 25, 1952, re- corded in Volume 436, Page 368, Deed Records of Lub- bock County, Texas; said 2, 237. 63 sq. ft. of land being more particularly described by metes and bounds as follows: BEGINNING at a point in the North line of U. S. 82 (4th) said point being the southwest corner of Lot 1, Block 12, Mayfield Sub vision in the City of Lubbock, Lubbock County, Texas. THENCE North along the west line of Lot 1, Block 12, a distance of 17. 55 feet to a point in the propo-eed north right-of-way line of U. S. 82; THENCE N 890591 E along a line 17. 55 feet from and paral- lel to the south line of Lot 1, Block 1.2, a distance of 127. 5 feet to a point in the east line of Lot 1; MR:kr THENCE South along said line a distance of 17. 55 feet to a point in the existing North line of U. S. Highway 82; THENCE S 89059t West along said line a distance of 127. 5 feet to the PLACE OF BEGINNING. THAT owner, Phillips Petroleum Company, and all others, if any, whose interest may appear, be offered through the Right -of -Way Department the amount appraised as the value and total damages, if any, for the. fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock and unless accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for street purposes.
