HomeMy WebLinkAboutResolution - 4608 - Agreement - TTU Museum - Loan, Buddy Holly Memorabilia - 09_22_1994Resolution No. 4608 Council Date 09 / 22 / 9 4 Item No. 12 F—W$JAIWMZj BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Agreement by and between the City of Lubbock and Texas Tech University Museum for the loan of the Buddy Holly memorabilia, attached herewith, which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. The Museum of Texas Tech University (TTU) agrees to abide by all applicable guidelines for bans as defined by the lender. 2. Objects on ban will not be altered or modified in any way. 3. TTU will exercise due care In the custody, handling, transport. unpacking and repacking of the ban. 4. Upon unpacking, .TTU will immediately acknowledge receipt of the ban by signing and returning a copy of the Lender's agreement. In the event that the Lender does not supply a loan agreement, this TTU Incoming loan form will sufffice. 5. On return. the loan will be packed in the same manger as received and with the same cases, pads, and packing materials where possible. GF. (.7,e 6. Lender. TTU will undertake to maintain constant and adequate protection of the loan objects) to minimize the risk of theft, or damage from handling. TTU will also undertake . to maintain constant and adequate protection of the loan object(s) from the hazards of fire and flood, exposure to harmful light levels, extremes of temperature and relative humidity, pest attack and harmful atmospheric conditions. 8. Any changes in the condition of the loan object(s), variation from the stated guidelines in this agreement, loss, theft, or damage to the loan in transit, during storage. or exhibit will be reported immediately to the Lender. A written condition report will be available on request. 9. No material belonging to the Lender will be loaned to third parties without permission from the Lender. 10. No material included in this collection will be exhibited without the express written consent of the City of Lubbock. A COPY OF THIS FORM WILL BE RETURNED WITH THE LOAN MATERIAL AT THE END OF - THE LOAN PERIOD Special Conditions/Exceptions The City of Lubbock will insure the memorabilia is boxed and inventoried prior to delivery to the Museum of Texas Tech University The City of Lubbock will have the right to inspect the Buddy Holly materials, prefer- ably with 24 hours notice, during regular Museum hours in the company of Museum personnel with proper security authorization. The City of Lubbock shall give thirty (30) days notice to the Museum for access to or removal of the Buddy Holly materials for display, exhibition, demonstration, or other non -curatorial purposes. No person(s) other than designated City of Lubbock representatives and .museum staff will be allowed access to or inspection of the Buddy Holly material. This agreement may be renewed for an additional eighteen months in six month extensions. At the time of each renewal the material will be re -inventoried by Museum P91-Sonnel and an inventory report will be transmitted to the appropriate City official. I have checked with Don Vandiver and there are no substantive changes to the loan agreement extension, therefore Council action is not required. The extension is for a six month period and will need to be extended again in May of 1996. Enclosed you will find two copies of the loan form for your signature.
