Vandiver; Fi Assistant City Attorney DGV:dp\G:4:edxs\TNRCC#2.Res August 15, 1994 Resolution No. 4587 Item #16 August 25, 1994 CONTRACT NUMBER 3100000042 INTERLOCAL CONTRACT STATE OF TEXAS § § COUNTY OF TRAVIS § Both parties to Interlocal Contract Number 3100000042, the City of Lubbock (PERFORMING PARTY) and the Texas Natural Resource Conservation Commission (RECEIVING AGENCY), agree to amend said Contract as follows: 1. Paragraph E of Attachment A, Section VIII of the Contract (relating to Transfer of Grant Funds) is hereby deleted in its entirety. This, now deleted, Paragraph (displayed here in struck -out text) formerly, as a result of previous Contract Amendment, read as follows: X. Attachment B, Article 4 of the Contract (relating to Financial Status Report) is amended to change both the Article and the Article title. This Article (displayed here in struck -out text) formerly read: With this amendment the Article now reads: ARTICLE 4. FINAL FINANCIAL STATUS REPORT A final Financial Status Report, utilizing TNRCC Form 269a, shall be submitted by the Performing Party by no 3 later than 45 days following the end of the Contract period. When submitting the final Financial Status Report for the ov(:rall program budget set forth in Attachment E, Article 4 of this Contract (relating to Approved Program Budget), the Performing Party shall attach to it a full detailed accounting showing actual expenditures (and any savings or over charges) for each individual line itF.m contained in Attachment E, Article 3 of this Contract (relating to Clarification of Commission's Approval). Reported subtotals shown on this detail sheet, corresponding to Sections (a) through (e) of Article 3 of the Contract, must respectively support the figures reported in the final Financial Status Report for the budget categories titled, "Personnel/Salary," "Supplies," "Equipment," "Construction," and "Other." X. Section (a) of Attachment C, Article 13 of the Contract (relating to Authorized Representatives) is amended to update the designation and title of the RECEIVING AGENCY'S Authorized Representative. This Section (displayed here in struck -out text) formerly read: With this amendment the Section now reads: (a) The EXECUTIVE DIRECTOR hereby identifies the person authorized to give direction to the Community: Mark Evarts, Proiect Manaaer Office of Pollution Prevention and Recycling/ Clean Texas 2000 Texas Natural Resource Conservation Commission P.O. Box 13087 Austin, Texas 78711-3087 5. The Contract is amended to replace the previous Attachment E (Approved Program Design), which in accordance with Paragraph I of Attachment A, Section VI of the Contract (relating to Submittal and Approval of Program Design) became part of the Contract No. 3100000042 Amendment Number 02 - Page 2 Contract upon acceptance by the RECEIVING AGENCY. The former, previously approved, Program Design is shown in its entirety in Appendix One of this, Amendment Document, while the new Attachment E, which is the result of this Amendment, is presented in Appendix Two of this Amendment. APPROVAL OF PROGRAM DESIGN (a) The program design described and contained in this Attachment was approved by the RECEIVING AGENCY on May 5, 1993. (b) This approval is in accordance with requirements and procedures set forth in Attachment A, Item VI of this Contract (relating to Submittal and Approval of Program Design). (c) Incorporation into this Contract of the approved program design, as Attachment E (including Exhibits 1 - 3 to Attachment E), is in accordance with Attachment A, Item VI, Section (I) of this Contract (relating to Submittal and Approval of Program Design) . ARTICLE 2. PROGRAM DESIGN SPECIFICS (a) Exhibit 1 of this Attachment (titled, "Grant Proposal for Clean Cities 2000) consists of the PERFORMING PARTY'S originally proposed RFP's 12476 and 12477. (b) Exhibit 2 of this Attachment (titled, "Evaluation of Lubbock Clean City Program -Design Proposal") is a copy of the RECEIVING AGENCY'S evaluation report concerning the PERFORMING PARTY'S originally proposed program design. (c) Exhibit 3 of this Attachment (titled, "Response to TWC" with its attached purchase specifications #'s 5-966 and S-973) is the PERFORMING PARTY'S response to the RECEIVING AGENCY'S evaluation report and describes revisions, deletions and/or additions to the PERFORMING PARTY IS originally proposed program design. ARTICLE 3.
