HomeMy WebLinkAboutResolution - 051172P - Land Acquisition - Bureau Of Outdoor Recreation - Canyon Lakes Project - 05/11/1972i i MR:ll �1 �I RESOLUTION WHEREAS, it has been determined by the City Council that the Can- yon Area within the City of Lubbock, Lubbock County, Texas, should be de- veloped for public open space called the Canyon Lakes Project; and, WHEREAS, the Bureau of Outdoor Recreation has contracted with the City for matching funds to aid in development of said project; and, WHEREAS, it is necessary to acquire for the Canyon Lakes Project fee simple title to the land hereinafter described, owned by Billy Joe Hood Estate, Kathryn Hood; and, WHEREAS, the City Council has caused appraisal to be made of said land, and the value and total damages, if any, to the owner, and all others whose interest may appear, for fee simple title to said land has been apprai ed and the Council finds the price offered to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT The City of Lubbock acquire for the purposes of developing public open space described as the Canyon Lakes Project fee simple title to the land lying and being situated in the County of Lubbock, Texas, and des- cribed as follows, to -wit: A tract of land out of Section 17, Block A. Lubbock County, Texas, and being more particularly described by metes and bounds as follows; to -wit: BEGINNING at an iron pipe in the East line of Section 17, Block A, 1101. 9' North of its South- east corner of said Section 17, which iron pipe is the Northeast corner of the W. O. Bearden 30 acre tract and the Southeast corner of this tract; THENCE West along the North line of the said W. O. Bearden 30 acre tract 1, 332. 6' to a 2" x 2" wooden stake, the Northwest corner of the said W. O. Bearden 30 acre tract and the Southwest corner of the c tract; THENCE North 33 ° 03' East 254. 6' to a long 3/4" iron pipe, and corner; THENCE North parallel to the East line of Sec- tion 17, 468. 5' to a 1" iron pipe set in the South fence line of the Joe Manicapelli tract as is record- ed in a deed in Vol. 337, Page 525 of the Lubbock County Deed Records, which iron pipe is 124. 65' South 83 ° 48' East from the fence corner at the Southwest corner of the Joe Manicapelli tract and is the Northwest corner of this tract; THENCE South 83 ° 48' East .along said fence line on the South line of the said Joe Manicapelli tract pass- ing a fence corner at 953. 35' and continuing to a total distance of 985. 35' from the said Northwest corner to a 1" iron pipe set for the Northeast corner of this tract; THENCE South 23 ° 20' East 467.151 to a large iron spike set in the East shoulder of a Lubbock .County Road as the same existed in 1956; THENCE South 19 ° 30' East 88. 89' to a large iron spike set in the East line of Section 17, Block A, and corner; THENCE South along the East line of Section 17, Block A, 64. 77 1 to the PLACE OF BEGINNING, less oil and gas heretofore reserved. THAT the owner, Billy Joe Hood Estate, Kathryn Hood and all others, if any, whose interest may appear, be offered through the Planning Depart- ment the amount established as the fair market value and total damages, if any, for fee simple title to and acquisition of said land for the pruposes here- in stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire fee simple title to said land, as hereinabove described, for park purposes.
