RESOLUTION
WHEREAS, it has been determined by the City Council that the Can-
yon Area within the City of Lubbock, Lubbock County, Texas, should be de-
veloped for public open space called the Canyon Lakes Project; and,
WHEREAS, the Bureau of Outdoor Recreation has contracted with the
City for matching funds to aid in development of said project; and,
WHEREAS, it is necessary to acquire for the Canyon Lakes Project
fee simple title to the land hereinafter described, owned by B. J. Hood Est
Kathryn C. Hood; and,
WHEREAS, the City Council has caused appraisal to be made of said
land, and the value and total damages, if any, to the owner, and all others
whose interest may appear, for fee simple title to said land has been apprais
ed and the Council finds the price offered to be fair and equitable; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock acquire for the purposes of developing put
lic open space described as the Canyon Lakes Project fee simple title to the
land lying and being situated in Lubbock County, Texas and described as
follows, to -wit:
A tract of land out of Section 16, Block A, Lub-
bock County, Texas and being more particularly
described by metes and bounds on the Exhibit
attached hereto.
THAT the owner, Billy J. Hood, Estate, Kathryn C. Hood, and all
others, if any, whose interest may appear, be offered through the Planning
Department the amount established as the hir market value and total damages
if any, for fee simple title to and acquisition of said land for the purposes
herein stated, for the use and benefit of the City of Lubboi*, and unless ac-
cepted forthwith, the City Attorney is hereby authorized and instructed to
institute condemnation proceedings for and on behalf of the City of Lubbock
to acquire fee simple title to said land, as hereinabove described, for park
purposes.

cribed as follows. to -wit:
A tract of land out of Section 17, Block A,
Lubbock County. Texas, and being more
particularly described by metes and bounds
as follows; to -wit:
BEGINNING at an iron pipe in the East line of
Section 17. Block A, 1101. 9 F North of its South-
east corner of said Section 17. which iron pipe
is the Northeast corner of the W. O. Bearden
30 acre tract and the Southeast corner of this tract;
THENCE West along the North line of the said W. O.
Bearden 30 acre tract 1, 332. 61 to a Z" x 2" wooden
stake, the Northwest corner o"f ,the said W. O. Bearden
30 acre tract and the Southwest Corner of this s tract;
THENCE North $8. 031 East 254.61 to a long
3/4" iron pipe, and corner;
THENCE North parallel to the East line of Sec-
tion 17, 468.5' to a 1" iron pipe set in the South
fence line of the Joe Manicapellt tract as is record-
ed in a deed in Vol. $37, Page 525 of the Lubbock.
County Deed Records, which iron pipe is 124.651
South 83° 480 East from the fence corner of the
Southwest corner of the Joe blanicapellt tract and is
the Northwest corner of this tract;
THENCE South 83. 481 East isbng said fence line on
the South line of the said doe Manicapeili tract pass-
ing a fence corner at 053.351 and continuing to a total
distance of 985. 85' from the said Northwest corner
to a V iron pipe get for the Northeast corner of this
tract,
THENCE South 230 201 East 467.161 to a large iron
spike set in the East shoulder of a Lubbock County
Road as the same existed in 1856;
THENCE South 180 301 East 88.89' to a large iron,
spike set to the East line of Section 17, Block A,':i iod
corner;
THENCE South along the East line of Section 17,
Block A, 64.77' to the PLACE OF BEGINNING, less
oil and gas heretofore reserved.
THAT the owner, Billy Joe Hood Estate, Kathryn Hood and all others,
If any, whose interest may appear, be offered through the Planning Depart-

any, for fee simple title to and acquisition of said land for the pruposes here-
