BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized
and directed to execute for and on behalf of the City of Lubbock an approval
by the City of Lubbock of the State Highway construction plans for the in-
stallation of traffic signs on Loop 289 between U. S. 62-82 Southwest, North
and East to U. S. 62-82 Northeast, attached herewith which shall be spread
upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.

WHEREAS, it has been determined by the City Council that the Canyon
Area within the City of Lubbock, Lubbock County, Texas., should be developed
for public open ispace called the Canyon Lakes Project; and,
WHEREAS, the Bureau of Outdoor Recreation has contracted with the
City for matching funds to aid in development of said project; and,
WHEREAS, it is necessary to acquire for the Canyon Lakes Project
fee simple title to the lead hereinafter described, aimed by H. L. Pont; and,
WHEREAS, the City Council has caused appraisal to be made of said
land, and the value and total damages, if any, to the owner, and all others
whose interest may appear, for fee simple title to said land has been app-
raised and the Council finds the price offered to be fair and equitable; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY CCUNCIL OF THE CITY OF LUBBOCK:
THAT the City of Lubbock acquire for the purposes of developing pub-
itc open space described as the Canyon Lakes Project fee simple title to the
land lying and being situated in Lubbock County, Texas, and described as
follows, to -wit:
A tract or parcel of land being a tract of
land in the County of Lubbock and State of
Texas, out of Southeast (SE) one-fourth I
of Section Seventeen 47), Block A, Lubbock
County, Texas, and being ;snore particularly
described as follows:
BEGINNING at a point that is 2110. 7 feet
North and 1320 feet West of the Southeast:
(SE) corner of Section Seventeen (17E),
Block A, said point being the Northwest
(NW) corner of a tract of land conveyed by
Mrs. G. A. Shenton and Mrs. Ada Bowles
to M. F. Landwer by deed recorded is Vol.
174, page 636 of Deed Records of Lubbock
County, Texas for the beginning corner
of this tract;

THENCE West 50 feet;
THENCE North $29 feet;
THENCE East 247 feet;
THENCE South 529 feet;
THENCE West 197 feet to POINT OF
BEGINNING; and Including one five room
basement house, one well and other ap-
purtenances thereon. This conveya nde
1s made subject to the mineral reserva-
tion, if any that xnay be of record in the
deed records of Lubbock County, Texas,
and to any oil, gas or other mineeral
leases that may be outstanding on the
land hereby conveyed.
THAT the owner, H. L. Poast, and all *there, If any, whose interest -
may appear, be offered through the Planning Department the amount extWt
fished as the fair market value and total Damages, if any,, for fee simple
title to and acquisitiaa of said land for the purposes herein stated, for the
use and benefit of the City of Lubbock, and unless accepted forthwith, the
City Attorney is hereby authorized and instructed to institute condemnation
proceedings for and on behalf of the City of Lubbock to _acquire fee simple
title to sal land, as hereinabove described, for park purposes.
