RESOLUTION ACCEPTING IMPROVEMENTS ON PORTIONS OF A ALLEY, AS LISTED BELOW
AND ORDERING THE ISSUANCE OF CERTIFICATES IN EVIDENCE OF ASSESSMENTS LEVIED.
WHEREAS, the City of Lubbock heretofore passed various street improvement
ordinances and resolutions and entered into contract with Zahn Pavers, Inc.,
G.W.O. 10,733, for the making and construction of street and or alley improve-
ments on portions of numerous alleys, streets and/or avenues in said City in-
cluding among others the following:
The East-West and North -South alley between 69th Street, 70th Street and Nash-
ville Drive and from its intersection with the .East Property Line of Memphis Avenue
to its intersection with the Southwest Property Line of Nashville Drive and from
the intersection with the East-West alley South of 69th Street to its intersection
with the Northeast Property Line of 70th Street, known and designated as sub -unit
Number 4 of Unit Number A-411.
AND WHEREAS, the improvements upon the said portions of the abovementione
alley has been inspected and found to have been constructed in accordance with
terms of said contract G.W.O. 10,733.
THEREFORE, BE IT RESOLVED BY THE CITY OF LUBBOCK, TEXAS.
I.
That the improvements on said portions of the abovementioned alley be and
the same is hereby accepted, and the City Engineer be and he is hereby authorized
to direct payment of the City's portion of the cost.
II.
That the Mayor and City Secretary be, and they are hereby instructed to ex-
ecute and deliver certificates in evidence of the assessments levied against the
parcels of property abutting upon the said portions of the alley listed above and
against the owners of such property in accordance with law and in the manner pro-
vided in said contract, and the proceedings with reference to said improvement
and assessments where such assessments were levied.
This resolution shall take effect and be in force from and after its
passage.

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized and
directed to execute an agreement between the City of Lubbock and the Atchison
Topeka and Santa Fe Railway Company for a storm sewer pipeline crossing on
Avenue R, attached herewith which shall be spread upon the minutes of the Council
and as spread upon the minutes of this Council shall constitute and be a part of this
Resolution as if fully copied herein in detail.
Passed by the City Council this _day of PECEMUR 1971.

A. Standard Manufacturer's and Contractor's Liability
Insurance. The Contractor shall furnish evidence to Santa Fe
that with respect to the operations he performs, he carries

B. Contractor's Protective Liability Insurance. The Con-
tractor shall -furnish evidence to Santa Fe that, with respect to `
the operations performed for him by subcontractors, he carries in
his own behalf regular Contractor's -Protective Liability Insurance.•
providing for a limit of not less than one hundred thousand dollars
($1.00,000.00) for all damages arising out of bodily injuries to/or
death of one person, and subject to that limit for each person, a
total limit of three hundred thousand dollars ($300,000.00) for all
damages arising out of bodily injuries to/or death of two or more
persons in any one accident, and Protective Property Damage
Liability Insurance providing for a limit of not less than one
hundred thousand dollars ($100,000.00) for all damages arising out
of injury to/or destruction of property in any one accident and
subject to that limit .per accident, a total (or aggregate) limit
of three hundred•thousand dollars ($300,000.00) for all damages
.arising out of injury to/or destruction of property during the
policy period.
In addition to the coverage°provided in sub -paragraphs 9A and.
9B above, it is expressly understood that an umbrella policy will
be provided with coverage of at least an aggregate amount of one
million dollars ($1,000,000.00).in'connection with the operations
performed by the contractor andjn connection with operations
