RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby and directed to
execute for and on behalf of the City of Lubbock and Kerr Construction Company
a Paving Release attached herewith which shall be spread upon the minutes of
the Council and as spread upon the minutes of this Council shall constitute and
be a part of this Resolution as if fully copied herein in detail.
Passed by the City Council this 2 8 day of OCT08ER , 1971.

PAVING RELEASE
COUNTY OF LUBBOCK
WHEREAS. heretofore, on June 25, 1970, the City of Lubbock passed
Ordinance No. 5901, such instrument being recorded in Volume 1237, Page 71.
of the Heed Records of Lubbock County, Texas, such Ordinance containing a
notice of improvements and apportionment of costs of such improvements, by
assessing alien upon the property abutting thereon, and in such Ordinance
there was included paving assessments for certain hereinafter described Pav-
ing Units; and.
Vir"HEREAS, under such Paving Units, such Improvements have created
no lien or liens against the property assessed pursuant to said Paving Units,
by reason of the fact that such paving improvements upon the streets have not
been made and there is no immediate plan of making street improvements upon
the streets under said raving Units, and it is expedient to remove the cloud
and apparent lien placed upon the title of property abutting the streets as afore-
mentioned; NOW THEREFORE:
KNOW ALL MEN BY THESE PRESENTS;
THAT the City of Lubbock and Kerr Construction Company, acting by
and through their officers heretofore duly authorized, in consideration of the
premises, do hereby and by these presents, RELEASE, RELINQUISH, AND
FOREVER QUIT CLAIM to the owner or owners of property affected by the
paving assessment liens hereinabove mentioned, their heirs, administrators,
executors and assigns, all right, title and interest the City of Lubbock and Kerr
Construction Company may have In and to these lots, tracts or parcels of land
being situated in the City of Lubbock, Lubbock County, Texas, and being fur-
ther described as follows, to -wit -
Unit 2206-9 46th Street from 13. 00 feet Rest of the
W. P. L. of Avenue D to 9.00 feet West
of the W. P. L. of Avenue A.
Part of Avenue `p from the South Lip Line Of
Unit 2208-28 Loop 289 to 103.55 feet South of the
S. P. L. of Loop 289. The below de-
scribed property only to be released.
BEGINNING at a point which is North
0 degrees 02' 57" West a distance of
20. 00 feet from the Northwest corner
of Lot 250, Beverly heights Addition
to the City of Lubbock, Texas;
THENCE North 0 degrees 02' 57" West
a distance of 106.55 feet to a point in
the South R. O.W. Line of Loop 289;
THENCE North 89 degrees 57' 03" East
along the South R. 0. W. Line of Loop
289 a distance of 150. 00 feet;
THENCE South 0 degrees 92' 57" East
a distance of 106. 55 feet;
THENCE South 69 degrees 57' 03"
West a distance of 150.00 feet to
the POINT OF BEGINNING.
Part of 58th Street from the East Lip Line of
Unit 2210-1 Avenue Q South Drive to the W. P. L.
of Avenue H (less the existing pave-
ment on the North 112 of 58th Street
adjacent to the Drive In Subdivision).
The below described property only to
be released.
BEGINNING at a point which is 30. 00
feet South and 50.00 feet West of the
Northeast corner of the Southwest 114
of Section 2. Block E, Lubbock County,
Texas;
THENCE North 89 degrees 51' West a
distance of 1154.64 feet to a point said
point beginning of a 25.00 foot curve to
the left, the radius point of which bears
South 25.00 feet and having a delta angle
of 131 degrees 31' a tangent of 55.52 feet
and an arc length of 57.38 feet;
THENCE around said 25.00 foot curve to
the left an arc distance of 57. 38 feet to a
point, said point being to the Northeast
R.O. W. Lim of Avenue Q, South Dbtve;
THENCE South 41 degrees 22' East along
the Northeast R, a W. Line of Avenue Q
South Drive a distance of 77.73 feet;
1H ENCE South 89 degrees $1' East 1132.10
feet to a Point in the West R.`O.W. Line of
Avenue H;
THENCE North along the West R. d. W. Line
Of Avenue 11 a distance of 100.00 feet to the
POINT OF BEGINNING.
Unit 2212-1 East 14th Street from 16.50 feet East of
the E: P. L. of Date Avenue to 400.00 feet
East of the E. P. L. of Elm Avenue.
Unit 2213-1 Indiana Avenue from 6.00 feet South of the
S.P. L. of 62nd Street to the N. P. L. of 66th
Street (East Leg).
This Release affects Any the property hereinabove described and in
no way affects any property or lions not specifically described herein, and
all liens and apparent liens against property owners not otherwise released
are hereby expressly retained.
