HomeMy WebLinkAboutResolution - 092371I - Pavement Improvements - City Engineer - 16Th Street - 09_23_1971_. - g.x^ 3013 VIMREAS, the City Council has heretofdre determined that the City would contribute the customary city portion of the cost of alley paving improvemarta, as determined by City of Lubbock paving policy, to be constructed in accordance with the standard City of Lubbock alley plats and specifications as approved by the City Engineers and the owners of property abutting the East-West alley be- tmen 16th Street and 17th Street from Orlando Avenue to Norfolk Avenues have requested permission to have pavement improvements constructed on the aforementioned alley and the wing of said alley is needed to provide access to the area during itsconstruction period, and the City Engineer has approved the plans and speci- fications for such improvements, and, WHMUASt the owners of the property abutting on the herein described alley will contract separately with a competent contractor for the above alley improve- mentas, and said bTrovuments will be constructed in accordance with the above - motioned plane and specifications under the supervision of the City Engineer, and the said owners desire that the City contribute its customary share towards such paving and, Wmmu5, the contract cost of the paving improvements will not exceed $5,448.769 the total cost not over $5j12l.2Q# and the Cityts share in connection therewith would not exceed $572.20p leaving the property owner's portion tilt to exceed $5#149 000 such costs being well within the current prices for paving obtained by competitive 'bidding, and that such paymnt to be wade by the City is reasonable, fair, and just to the abutting property owners# the City and all other persons affected thereby, and that the aura of $572.20 will be duly budgeted, TMUM)RE, BE IT RESOLVED BY THE CITY CDUMltL OF 'TES CITY OP IMBOCKt Section 1. THKT, the City Engineer be and he is hereby authorized to approve plans and specifications for paving on the alley herein described. provided that such plans and specifications meet the usual requirements for paving on alleys within the corporate limits of the City of Lubbock; said alley being as follows, to -wits The East-West alley between loth Street and 17th 8tweet from its Intersect.- with the Went Property Line of Orlando Avenue to it • intersection with the Ewes, Property Line of Worfolk Avenue, Unit A-415 The City Engineer is further authorized ar,> Zl re zted to duly inspect said paving construction on said alley and -to require .crsct compliance with the approved plans and spec fi.catione, and utihn completion of said paving, and upon final approval by the City Engineer ted r-certance of such improvements by the City Council, the City En�ineet is aathoritct W, pay the contr:ctor in full and final payment of the City ,a share of the cost of the abovementioned improve,macnts a suer not to exceed $299.76 which is the City's share ($572.20) less $272.44 engineering, leaving the amount due the contractor from the property owners not to exceed $5.149.44. Section 2. This authority is conditioned that the owners of abutting property and the contractor will pay for all material and labor and costs inci- dental to such construction, indemnify the City of Lubbock against any costs# claims or damages of every mature pertaining thereto, and that the Contractor furnish the City Engineer with acceptable evidence that the contractor and his sub -contractors# if any, are adequately covered by public liability and property damage insurance polities, that the said owners of abutting property will cause such paving to continue to be done according to the approved plans and specifi- cations, and that upon completion thereof and final approval of the City Engineer, all n improvements designated herein shall be a permanents part of said alley and the property of the City of Lubbock, without any liability whatsoever, except for the payment of a sum of $299176 to the contractor. On motion of Councilman , seconded by Councilman , the foregoing resolution was unanimously passed by the City Council this 23rd day of September, 1971. J. H.
