ORDER AND RESOLUTION
AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO VERNONS
ANN.CIV.STAT., ART. 1446c, WITH REGARD TO ARATE CHANGE APPLICATION
FILED BY SOUTHWESTERN PUBLIC SERVICE COMPANY ("SOUTHWESTERN")
WITH THE CITY.
WHEREAS, Southwestern has heretofore filed a Statement of Intent to change rates
for residential, commercial, industrial, and other retail customers for usage on and after
October 15, 1993; and
WHEREAS, such proposed change will result in an overall reduction in electric rates
of two and nine tenths percent (2.9%) for the customers of Southwestern; and
WHEREAS, such proposed change is not a major change requiring a public hearing
under the provisions of Vernon's Ann.Civ.Stat., Art. 1446c; and
WHEREAS, the City Council has previously implemented the proposed rates on an
interim basis pending a final resolution of Southwestern's rate case, Docket No. 11520, at the
Public Utility Commission of Texas; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT, pursuant to the provisions of Vernon's Ann. Civ. Stat., Art. 1446c, it is ordered
that Southwestern`s proposed schedule of electric rates previously implemented on an interim
basis, which are reflected on the tariffs and schedules attached to its original Application for
Interim Rate Change, be made permanent.

The Company will not construct, own. or maintain underground fines on the
customer's premises. Construction for underground tines will be built to the
specifications of the Company and will be arranged and paid for by the customer.
The customer is responsible for any trenching and backfilling necessary for
Construction.
CHARACTER OF SERVICE: A-C; 60 hertz; single phase; 120 volts.
TERM OF CONTRACT: A period of not less than three years.
LINE EXTENSIONS: The Company will make line extension in accordance with its
standard line extension policy.

Dear Mayor Langston and Members of the City Councilt
Attached is a supplemental application for permanent rate
change, and a sample resolution adopting the final electric
rates approved by the Texas Public Utility Commission in its
December 16, 1993 meeting.
The sample resolution is simply a model for you to follow.
The resolution should be adopted to enable Southwestern
Public Service Company to lawfully charge the rates in
Lubbock as set out in the tariffs. The iteri■ rates you
adopted last fall that vent into effect October 15, 1993,
are the same as these rates, and the tariffs which were filed
with you in October 1993, accurately reflect the final electric
rates approved by the Public Utility Commission. if you will
retain those tariffs it will obviate the cost of providing
you with new tariff sheets.
However the attached tariff 05117.1, Ttood tight Systems
which was approved by the Public Utility Commission on
December 16, 1993, was not included with the tariffs you
approved last fall. Therefore I would request you approve
it in your final rate order or resolution.

The proposed change is not a major change under the provisions of Vernon's Ann. Civ.
Stat., art. 1446c, Public Utility Regulatory Act ("PURA"), Section 43, for which a public
hearing is required.

Southwestern requests the City to waive the requirement of publication of notice under
the provisions of PURA 143, since this proceeding involves a rate reduction.
WHEREFORE, PREMISES CONSIDERED, Southwestern Public Service Company
requests that its tariffs and schedules approved on an interim basis for all usage on or after
October 15, 1993, be made permanent, consistent with the Unanimous Joint Stipulation and final
order in Public Utility Commission of Texas Docket No. 11520.

Southwestern Public Service Company ("Southwestern") files this Supplemental.
Application for Permanent Rate Change with the City and would show as follows:
1.
Southwestern's rate case at the Public Utility Commission of Texas ("PUC' or
"Commission'), Docket No. 11520, was resolved by a Unanimous Joint Stipulation of all
parties, including representatives of certain Cities in Southwestern's Texas service territory.
Under the Stipulation and an interim order of the AU, the rates for non -city ratepayers were
implemented on an interim basis for usage on or after October 15, 1993, pending final resolution
of that docket.
II.
So that the City ratepayers could realize the same rate reduction at the same time as the
non -city ratepayers, Southwestern filed an Application for Interim Rates. The interim rates were
implemented by the Cities pending final resolution of PUC Docket No. 11520. On December
20, 1993, the PUC entered an order making the rates previously implemented on an interim
basis permanent.
The order of the Commission in Docket No. 11520 making the previously implemented
rates permanent having now become final, Southwestern files this Supplemental Application
requesting that the City enter its order and resolution to make permanent Southwestern's
schedule of electric rates previously implemented on an interim basis. These rates are reflected
on the tariffs and the schedules attached to Southwestern's Application for Interim Rate Change.

TERMS OF PAYMENT: Net in 16 days after mailing date; 5 percent added after 16 days.
If the sixteenth day falls on a holiday or weekend, the due date will be the next
work day.

FUEL COST RECOVERY: The above rate shall be increased by the applicable fuel cost
recovery factor per kilowatt hour as provided in Tariff Number 7100. However,
Flood Light Systems service provided by Company which is electrically connected
to a circuit previously metered by Company for other electric service shall not have
the above rate increased by the applicable fuel cost recovery factor.
TAX ADJUSTMENT (Applicable to sales inside corporate limits): Billings under this
schedule may be increased by an amount equal to the sum of the taxes payable
under federal, state and local sales tax acts, and of all additional taxes, fees, or
charges, (exclusive of ad valorem, state and federal income taxes) payable by the
utility and levied or assessed by any governmental authority on the public utility
services rendered, or on the right or privilege of rendering the service, or on any
object or event incidental to the rendition of service, as the result of any now or
amended laws after June 30, 1965.
CONDITIONS OF SERVICE: The Company will construct, own, operate and maintain on
the customer's promises, the required number of overhead flood lights, photo-
electrically controlled, installed on Company's poles of the type and size selected by
the customer, and having a secondary line span not exceeding 150 feet in length.
One span of secondary line not exceeding 150 feet in length may be furnished
under the above rate with each pole. Service requiring more than one span of
secondary line per pole will be furnished by the Company, provided the customer
pays an additional charge of $2.00 per month for each additional span not
exceeding 150 feet in length.
