HomeMy WebLinkAboutResolution - 081271V - Acquire Permanent Easement - 82Nd Street - 08_12_1971Ii GSL:ll RESOLUTION bg/ZQ/ V WHEREAS, the City Council of the City of Lubbock has determined the necessity of extending and constructing an electrical transmission line along a 19 portion of the SW 1/4 of Section 11, Block E-2, Lubbock County, Texas; and, (1,1 WHEREAS, it is necessary that a permanent easement and a temporary working easement be secured for the construction of said electrical transmission line, along a portion of the land hereinafter described, owned by FLOYD HONEY, DENVER DAVIS HONEY, CECIL WAYNE HONEY, FRANCES B. HONEY, and GLkNYS HONEY, a feme sole,; and, WHEREAS, the City Council has caused an appraisal to be made of said land for a permanent easement and a temporary working easement and the value in total damages, if any, to the owners, and all others whose interest may appea for a permanent electrical transmission line easement and a temporary working easement has been appraised in the amount of $12, 500. 00, and the Council finds such amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY !COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acquire a permanent easement and a temporary working easement for the purposes of extending and constructing an electrical transmission line along a portion of land lying and being situated in Lubbock j County, Texas, more particularly described as follows, to -wit: PERMANENT ELECTRICAL TRANSMISSION LINE EASEMENT BEGINNING at a point in the North line of 82nd Street 55 feet N 0 degrees 011 10" E and 30 feet S 89 degrees 591 40" W of the Southeast corner of the Southwest 1/4 of Section 11, Block E-2, Lubbock County, Texas, for a corner of this Easement; THENCE N Odegrees 011 10" E, 30 feet from and par- allel to the East Boundary Line of the Southwest 1/4 of Section 11, Block E-2, a distance of 2587. 64 feet to a point 30 feet South of the North Boundary Line of the Southwest 1/4 of Section 11, Block E-2 for a corner of this Easement; THENCE N 89 degrees 571 50" W, 30 feet from and parallel to the North Boundary Line of the Southwest 1/4 of Section 11, a distance of 2610. 00 feet to a point in the West Boundary Line of Section 11 for a corner of this Easement; 4 j THENCE N 0 degrees Olt 10" E, along the West Boundary Line of Section 11, a distance of 20 feet to a point 10 feet South of the Northwest corner of the Southwest 1/4 of Section 11 for a corner of this Easement; THENCE S 89 degrees 571 50" E, 10 feet from and parallel to the North Boundary Line of the Southwest 1/4 of Section 11, a distance of 2610. 0 feet to a point 30 feet West of the East Boundary. Line of the Southwest 1/4 of Section 11 for a corner of this Easement; THENCE N 0 degrees O1 r 10" E, 30 feet from and parallel to the East Boundary Line of the Southwest 1/4 of Section 11, a distance of 691. 35 feet to a point in the South Right of Way line of Loop No. 289 for a corner of this Easement; THENCE N 89 degrees 571 E along the South Right of Way line of Loop 289 a distance of 10 feet to a point 20 feet West of the East Boundary Line of the Northwest 1/4 of Section 11, for a corner of this Easement; THENCE S 0 degrees Olt 10" W, 20 feet from and parallel to the East Boundary Line of the Northwest 1/4 and Southwest 1/4 of Section 11, a distance of 3269. 00 feet to a point in the North line of 82nd Street for a corner of this Easement; THENCE S 69 degrees 59t 40" W, along the North line of 82nd Street, a distance of 10 feet to the PLACE OF BEGINNING. TEMPORARY WORKING EASEMENT BEGINNING at a point in the North line of 82nd Street, 55. 00 feet N 0 degrees Olt 10" E of the SE corner of the SW 1/4 of Section 11, Block E-2, Lubbock County, Texas, for a corner of this easement; THENCE N 0 degrees O1 r 10" E, along the East boun- dary of the SW 1/4 and the NE 1/4 of Section 11, a distance of 3269. 02 feet to a point in the South Right of Way line of Loop 289 for a corner of this easement; i THENCE S 89 degrees 572 W, along the South Right of Way line of Loop 289, a distance of 30. 00 j� feet to a point for a corner of this easement; THENCE S 0 degrees Olt 10" W, 30 feet from and parallel to the East boundary line of the NW 1/4 of Section 11, a distance of 681. 35 feet to a point in the North boundary line of the SW 1/4 of Section 11 for a corner of this easement; THENCE N 89 degrees 571 50" W, along the North boundary line of the SW 1/4 of Section 11, a dis- tance of 2610 feet to the NW corner of the SW 1/4 for a corner of this easement; THENCE S 0 degrees Olt 10" W, along the West boundary line of Section 11, a distance of 30 feet to a point for a corner of this easement; THENCE S 89 degrees 571 50" E, 30 feet from and parallel to the North boundary line of the SW 1/4 of Section 11, a distance of 2610 feet to a point 30 feet West of the East boundary of the SW 1/4 of Section 11 for a corner of this easement; THENCE S 0 degrees Olt 10" W, 30 feet from and parallel to the East boundary line of the SW 1/4 of Section 11, a distance of 2557. 64 feet to a point in the North line of 82nd Street for a corner of this easement; THENCE N 89 degrees 59t 40" E, along the North line',U 82nd Street, a distance of 30. 00 feet to the PLACE OF BEGINNING. THAT the owners, FLOYD HONEY, DENVER DAVIS HONEY, CECIL WAYNE HONEY, FRANCES B. HONEY, and GLENYS HONEY, a feme sole, and all others, if any, whose interest may appear be offered through the Right of Way Department the amount appraised as the value and total damages, if any, for the acquisition of the permanent easement and temporary working easement for the purposes previously stated, for the use and benefit of the City of Lubbocx and un- less accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the Cityof Lubbock to ac- quire easement rights as stated to the hereinabove,4escribed land.
