Young - Sunny Slope Addition - 07_08_1971070 Sr* 7s (5 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Agree- ment between the City of Lubbock and the Plains National Bank of Lubbock, Texas, attached herewith which shall be spread upon the minutes of the Coun cif and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Senter, Jr. , y Attorney .AGREE v1!: NT THE STAVE OF TEXTS § KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK § 71"M AGREENT MNT is entered into between the CITY OF LUBBOCK. a Home Rule Municipality and the PLAINS NATIONAL BANK OF LUBBOCK. TEXAS. WITNESSETH: WHEREAS. the PLAINS NATIONAL BANK OF LUBBOCK, TEXAS has previously granted to the CITY OF LUBBOCK a ten foot easement between Lot 1 and Lot 2, Tract C. Caprock Addition to the City of Lubbock, Lubbock County, Texas; and, WHEREAS, the PLAINS NATIONAL BANS{ OF LUBBOCK, TEXAS, now desires to build an addition to its drive-in banking facilities which will necessitate the use of a portion of the dedicated easement; and, WHEREAS, the construction plans reflect that a roof will be built over the easement and that the concrete footings will encroach upon the easement; and; VVREREAS, the CITY OF LUBBOCK and the PLANS NATIONAL BANK OF LUBBOCK. TEXAS, kave reached an Agreement whereby the PLAINS NATIONAL BANK OF LUBBOCK, 'TEXAS can use the easement: as aforesaid; NOW TIMIIEFORE, THE PREMISES CONSIDERED It is AGREED and UNDERSTOOD by the parties hereto that the CITY OF LUBBOCK does hereby consent to the construction of improvements to the drive- in banking facilities of the PLAINS NATIONAI, TANK OF LUBBOCK, TEXAS, which will encumber a portion of the dedicated easement located between Lot 1 and Lot 2, Tract C, Caprock. Addition to the City of Lubbock, Lubbock County, Texas; subject, however, to the express understanding that PLAIN'S NATIONAL 13AN-K OF LUBBOCK, TEXAS will bear all costs...Tor removal or replacement of the improvements within the easement or damages incurred to these improvements from tb use of the easement by the CITY OF LUBBOCK br the enfranchised utilities at any time; and the PLAINS NATIONAL BANX OF LUBBOCK, TEXAS, agrees not to enlarge or further burden beyond the use now contemplated so as to re- strict or limit the use of the easement by the CITY OF.
