BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock be and is hereby authorized
and directed to execute for and on behalf of the City of Lubbock a Quit Claim
Deed in favor of Doyle W. McLeod, attached herewith which shall be spread
upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.

QUIT CLAIM DEED
THE STATE OF TEXAS
COUNTY OF LUBBOCK
THAT THE CITY OF LUBBOCK, a Home Rule Municipal Corporation in
the County of Lubbock. State of Texas, for and in consideration of the sum of
ONE AND NO/ 100 ($1. 00) DOLLARS and other good and valuable consideration
to it in hand paid by DOYLE W. MC LEOD, of Lubbock County, Texas, the
receipt of which is hereby acknowledged, does hereby by these presents ABAN-
DON, DISCLAIM, RELEASE AND FOREVER QUIT CLAIM UNTO the said DOYLE
W. MC LEOD, of Lubbock County, Texas, all its': right, title and interest in and
to that certain tract or parcel of land, lying and being situated in the County of
Lubbock, State of Texas, described as follows, to -wit:
BEGINNING at the Northwest corner of Lot 1, Block 18,
Country Club Addition to the City of Lubbock, Lubbock
County, Texas;
THENCE Southerly along the West tine of Lots 1, and 2, Block
16, said Addition a distance of 180 72 feet to the Southwest
corner of Lot 2, Block 18, said Addition;
THENCE West a distance of 7.55 feet to a point;
THENCE Northerly and parallel to the Weht line of Lot x.
Block 18, said Addition, a distance of 16. 09 feet to a point;
THENCE West a distance of 7.66 feet to the Southeast
corner of Lot 9, Block 16, said Additions
THENCE Northerly along the East line of Lots 9, 10 and 11,
Block 18, said Addition, a distance ;of 111. 63 feet to the
Northeast corner of Lot 11, Block 16, said Addition;
THENCE East a distance of 15.1 feet to the POINT OF
BEGINNING.
TO HAVE AND TO HOLD the said premises together with all and singular
the rights, privileges and appurtenances thereto in any manner belonging unto the
said DOYLE W. MC LEOD, his heirs and assigns, nor any persons claiming under
it shall, at any time hereafaer, have, claim, or demand any right to title to the
aforesaid premises or appurtenances or any part thereof.

County, Texas, for and in consideration of the mum of ONE AND NO/100 Q1.00) DOLLARf
'to them in hand paid by the CITY OF LUBBOCK, a Home Rule Municipal Corporation of
:Lubbock County, Texas, the receipt and sufficiency of which is hereby acknowledged and
'!confessed, and for the further good and valuable consideration in benefits accruing and to
Accrue to the remainder of our property have by these presents GRANTED, BARGAINED,
♦SOLD and CONVEYED, and by these presents do GRANT, BARGAIN, SELL and CONVEY
unto the CITY OF LUBBOCK. its legal representatives. successors and assigns, for the
use and benefit of the public as a perpetual and permanent easement, the free and unin-
terrupted use, liberty of passage in, on, along, over, upon, under and across all that
property lying and being situated in the County of Lubbock. State of Texas, and being
more particularly described as follows, to-wLt:

THENCE Southeasterly along the East line of Lots S thru
11, Block 18, said Addition, a distance of 989. 06 feet to
a point;
THENCE East 15.1 feet to a point;
THENCE Northwesterly along the West line of Lots i
thru 4. Block 13, said Addition, a distance of 889.99
feet to the Northwest corner of Lot 1, Block 16, said
Addition;
THENCE West 16.1 feet to the POINT OF BEGINNING.
together with the rights of ingress. egress and regress at any and all times to accom-
plish the following purpose. to -wit -
allowing, but not limited to, constructing. reconstructing. repairing
and perpetually maintaining any and all types of water lines, sewer
lines, gas pipe lines, telephones and telegraph lines, electric trans-
missionli.nes and any other type of public utility, whether named here-
in or not, and which easement includes all times and seasons the right
of ingress, egress, and regress of motor vehicles and personnel en-
gaged either in such construction and repair or the reading of meters.
In order to assure the said CITY OF LUBBOCK. its successors and assigns of
continuing access and enjoyment of said easement, the said DOYLE W. MC LEOD and
LA JUNDA MC LEOD LEFTWICH do hereby expressly agree not to erect, build or
otherwise allow to be constructed any building or like permanent structure over the
said property heretofore described and should such building or structure be erected,
it to understood that the said CITY OF LUBBOCK, shall have the right to remove said
building or structure from the premises.
TO HAVE AND TO HOLD--t,he above described premises together with all and
singular the rights and appurtenances thereto in anywise belonging perpetually unto the
CITY OF LUBBOCK, its successors and assigns, and any and all public utilities now
or hereafter franchised by the CITY OF LUBBOCK to use the City streets and alleys
for so long as the public uses the same for the purposes herein granted.
