HomeMy WebLinkAboutResolution - 052771G - Permanent Easement And Temporary Working Easement - Section 5 Block E - 05_27_1971Oeb Z(79/ q W-WILM �3 RESOLUTION WHEREAS, the City Council of the City of Lubbock has determined the necessity of extending and constructing an underground water line along a portion of the NW-1 of Section 5, Block E, Lubbock County, Texas; and, WHEREAS, it is necessary that a permanent easement and a tem- porary working easement be secured for the construction of said under- ground water line, along a portion of the land hereinafter described, owned by JOHN F. LOTT, SR, and JOHN F. LOTT, JR. ; and, WHEREAS, the City Council has caused an appraisal to be made of said land for a permanent easement and a temporary working easement and the value in total damages, if any, to the owners, and all others whose in- terest may appear, for a permanent underground water line easement and a temporary working easement has been appraised in the amount of $500. 00, and the Council finds such amount to be fair and equitable; NOW THEREFOI BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acquire a permanent easement and a tem- porary working easement for the purposes of extending and constructing an underground water line along a portion of land lying and being situated in Lubbock County, Texas, more particularly described as follows, to -wit: PERMANENT UNDERGROUND UTILITY EASEMENT BEGINNING at a point being 10' North of the Southwest corner of the NW-1 of Section 5, Block E, Lubbock County, Texas, and in the West boundary line of the NW4 of Section 5, Block E, being the Southwest corner of this easement; THENCE East parallel to the South boundary line of the NW4 of Section 5, Block E, a distance of 2544. 271 to a point, being in the West R. O. W. line of U. S. High- way 87 and being the Southeast corner of this easement; THENCE Northwesterly along the West R. O. W. line of U. S. Highway 87, a distance of 12. 99' to a point, being the Northeast corner of this easement; THENCE West parallel to the South boundary line of the NW4 of Section 5, Block E, a distance of 2535. 97' to a point in the West boundary line of the NW4 of Section 5, Block E, being the Northwest corner of this easement; THENCE South along the West boundary of Section 5, Block E, a distance of 10' to a point being the PLACE OF BEGINNING. TEMPORARY WORKING EASEMENT BEGINNING at a point being 10' North of the Southwest corner of the NW4 of Section 5, Block E, Lubbock County, Texas, and in the West boundary line of the NW4 of Section 5, Block E, said point being the Southwest corner of this easement; THENCE East parallel to the South boundary line of the NW-1 of Section 5, Block E, a distance of 2544. 27' to a point, being in the West R. O. W. line of U. S. High- way 87, and being the Southeast corner of this easement; THENCE Northwesterly along the West R. O. W. line, a curve of 215' radius, a distance of 26. 72' to a point, being the Northeast corner of this easement; THENCE West parallel to the South boundary line of the NW! of Section 5 Block E, a distance of 2526. 55' to a point in the West boundary line of Section 5, Block E, being the Northwest corner of this Easement; THENCE South along the West boundary line of Section 5, Block E, a distance of 20' to a point, being the PLACE OF BEGINNING. THAT the owners, JOHN F. LOTT, SR., and JOHN F. LOTT, JR., and all others, if any, whose interest may appear be offered through the Right Of Way Department the amount appraised as the value and total damag s, if any, for the acquisition of the permanent easement and temporary working easement for the purposes previously stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire easement rights as stated to the hereinabo e described land.
