HomeMy WebLinkAboutResolution - 5730 - Interlocal Agreement - Lubbock County - Trade Corridor Study - 12_18_1997RESOLUTION NO. 5730 Item #22 December 18, 1997 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement, attached herewith, by and between the City of Lubbock and the County of Lubbock, and any associated documents, which Agreement shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Passed by the City Council this 18th day of December , 19 97. 0 Adji� WINDY TT , MAYOR ATTEST: hk Kayt I Darnell, City Secretary APPROVED AS TO CONTENT: i Bob Cass, City Manager APPROVED AS TO FORM: 'kmy Si s, sistan ity Att6m6y AS:gs/ccdocs/CtyofLb.res December 10, 1997 RESOLUTION NO. 5730 Item #22 December 18, 1997 INTERLOCAL COOPERATIVE AGREEMENT BY AND BETWEEN THE CITY OF LUBBOCK AND LUBBOCK COUNTY, TEXAS This Agreement entered into this I gtb day of pp 1997, by and between the CITY OF LUBBOCK, a Home Rule Municipal Corporation (hereinafter called "City of Lubbock") and the COUNTY OF LUBBOCK, a Political Subdivision of the State of Texas, hereinafter called "County of Lubbock"). WHEREAS, the establishment of the Southwest to Northwest International Trade Corridor (hereinafter called "the Corridor") has the potential of being an important and viable transportation link by and between Mexico, Canada, and the United States; and WHEREAS, the establishment of the Corridor through the West Texas area could promote economic development for the cities and counties of this area; and WHEREAS, the parties desire to investigate the feasibility of establishing the Corridor and are willing to fund the Study and any associated administrative expenses; and WHEREAS, it is necessary to employ an engineering firm to conduct a study (hereinafter called "the Study") to survey the feasibility of establishing the Corridor. NOW THEREFORE, it is agreed between the parties hereto that: I. SCOPE OF SERVICE A. County of Lubbock Responsibilities: County of Lubbock agrees to pay $24,015.56 which is its proportional share of the expenses by population for the Study. County of Lubbock agrees that said funds may be used for the funding of the Study and any operational costs or administrative expenses incurred by the City of Lubbock in implementing and administering the Study and incurred in the lobbying for or the promotion of the Corridor. B. City of Lubbock Responsibilities: City of Lubbock shall provide administrative services associated with the Study including any expenses related to the promotion and lobbying for the Corridor. The City of Lubbock shall also fund its proportional share of funding the Study and other related expenses. II. GENERAL CONDITIONS A. Term The term of this agreement shall be one (1) year from the date of execution. The parties agree that this Agreement may be renewed or extended by mutual consent. B. Amendments This Agreement may be amended at any time, provided that such amendments make specific reference to this Agreement, and are executed in writing, signed by a duly -authorized representative of both organizations and approved by the City of Lubbock Council or County of Lubbock Commissioners Court if required by law. Such amendment shall not invalidate this Agreement, nor relieve nor release City of Lubbock or County of Lubbock from its obligations under this Agreement. C. Revenues The parties agree hereto that all payments made pursuant to this Agreement must be made from current revenues available to each respective party. All revenues received by the City of Lubbock pursuant to this Agreement shall be placed in a special project fund in the City of Lubbock's general multi -purpose account. The City of Lubbock agrees to conduct an annual audit on the funds received pursuant to this Agreement. The status of funding shall be made available for County of Lubbock's review. D. Compliance The City of Lubbock and County of Lubbock agree to comply with all applicable federal, state and local laws and regulations governing the funds provided under this Agreement.
