HomeMy WebLinkAboutResolution - 5727 - Partial Paving Release - 1995 Assessment Paving Program - 12_18_1997RESOLUTION NO.5727 Item #17 December 18, 1997 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Partial Paving Release concerning certain paving units which were deleted from the 1995 Assessment Paving Program, and also to release certain abutting properties for which it was determined that no assessments were needed, attached hereto, which Release shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Hertel, City Engineer APPROVED AS TO FORM: Harold Willard, Assistant City Attorney H W:gs/ccdocs/ParPav1-Res December 1, 1997 19 97. ,•- RESOLUTION NO. 5727 File And Wurn To Item #17 @d Busy R-O.W December 18, 1997 38779 VOLJ�j $PacE2�J1 PARTIAL PAVING RELEASE THE STATE OF TEXAS § COUNTY OF LUBBOCK § WHEREAS, Resolution No. 5438 passed by the City Council on March 13, 1997, determined the necessity for making certain street and alley improvements as therein designated, which Resolution was filed as a matter of record in Volume 5459, Page 302 of the Official Real Property Records of Lubbock County, Texas, reference to which record is hereby made for all pertinent purposes; and WHEREAS, the City Council of the City of Lubbock finds and determines that the liens and/or clouds against certain abutting properties created by the filing of such Resolution should be released against such properties as are hereinafter described for the reasons hereinafter stated; NOW THEREFORE: KNOW ALL MEN BY THESE PRESENTS: I. THAT the following described property is hereby released and quitclaimed because no assessment was made against such property after a public hearing thereon because the City Council deleted such property from the paving assessment program at a public hearing, to wit: Unit Number 2240-90, 26th Street from LaSalle Avenue to Kewanee Avenue. II. THAT the following described properties in Unit Number 2241-8, 66th Street from Frankford Avenue to Iola Avenue, are hereby released and quitclaimed because no assessments were made against such properties after the public hearing thereon as a result of the cost of improvements having been prepaid, to wit: Strong Davis Addition, Tract A Faith Baptist Church Addition, Tract A Sagewood Addition, Tracts AB, and C Sagewood Addition, Lot 1 Stonegate Addition, Lots 1,18, and 19 THAT the following described properties in Unit Number 2242-4, Frankford Avenue from Spur 327 to 50th Street, are hereby released and quitclaimed because no assessments were made against such properties after the public hearing thereon as a result of the cost of improvements having been prepaid, to wit: Vol 5678PAGE252 Westac Addition, Lots 1-A,2,2-A,3-A,4-A-1,8, and 12 Frankford Business Park, Lot 1 Womble Addition, Tracts A and B The following metes and bounds described property: Beginning at a point which bears South 00 degrees 06 minutes 28 seconds West a distance of 2,379.56 feet and North 89 degrees 55 minutes 14 seconds West a distance of 55.00 feet from the Northeast corner of Section 36, Block A-K, Lubbock County, Texas; Thence South 00 degrees 06 minutes 28 seconds West along the present West' Right of Way line of Frankford Avenue and parallel to the East line of Section 36, Block A-K, a distance of 225.09 feet to a point; Thence North 89 degrees 53 minutes 48 seconds West along the North line of Tract `B", Womble Addition, a distance of 150.00 feet to a point; Thence North 00 degrees 06 minutes 28 seconds East parallel to the present West Right of Way line of Frankford Avenue, a distance of 225.17 feet to a point; Thence South 89 degrees 55 minutes 14 seconds East along a line parallel to the present North Right of Way line of 57th Street, a distance of 150.03 feet to the point of beginning. II. THAT all of the properties to which this partial release is applicable as hereinabove described are located within the corporate limits of the City of Lubbock, Lubbock County, Texas, and this Release is only applicable to the properties hereinabove specifically described and released.
