RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed
to execute for and on behalf of the City of Lubbock Agreements with local property
owners wherein such owners voluntarily consent to an assessment against their property
and the placement of a lien thereon in consideration for the property being included in the
1995 Paving Assessment Program, which agreements are attached hereto and shall be
spread upon the minutes of the Council and as spread upon the minutes of this Council
shall constitute and be a part of this Resolution as if fully copied herein in detail.

This Agreement is entered into at Lubbock, Texas, by and between the City of
Lubbock, Texas, hereinafter referred to as "City", and Lv s y,u C- T re5 21)

WITNESSETH:
WHEREAS, more than fifty percent (50%) of the abutting property owners for the

as part of the 1995 Paving Assessment Program of the City; and
WHEREAS, Owner has title to property which abuts a portion of the street/alley for
which paving improvements have been requested; and
WHEREAS, the City Council has determined the necessity for the above -described
improvements and the same should be made in accordance with Chapter 313 of Vernon's
Texas Codes Annotated Transportation Code;
NOW THEREFORE, for and in consideration of the covenants and conditions herein
contained, City and Owner agree as follows:
I.
City agrees to include the above -described street/alley in its 1995 Paving Assessment
Program and to pave or contract for the paving of such street/alley in accordance with the
procedures and methods outlined in Chapter 313 of Vernon's Texas Codes Annotated
Transportation Code.
II.
Owner understands and agrees that the governing body of the City at a public hearing

herein agrees that paving such street/alley will increase the value of Owner's property at least

improvements and the same should be made in accordance with Chapter 313 of Vernon's
Texas Codes Annotated Transportation Code;
NOW THEREFORE, for and in consideration of the covenants and conditions herein
contained, City and Owner agree as follows:
I.
City agrees to include the above -described street/alley in its 1995 Paving Assessment
Program and to pave or contract for the paving of such street/alley in accordance with the
procedures and methods outlined in Chapter 313 of Vemon's Texas Codes Annotated
Transportation Code.
Owner understands and agrees that the governing body of the City at a public hearing
on or about Avg, j,7- /4 , 14 a -,F- , established an enhancement rate of $4 per
linear foot for Owner's property which abuts the street/alley to be improved, and Owner
herein agrees that paving such street/alley will increase the value of Owner's property at least
$ 17, 'Lq per linear foot and that an assessment rate of $ /j. jq_ per linear foot of
abutting property is fair and reasonable. The legal description for the Owner's property
whose value will be increased by the improvements herein described is as follows:

Owner further agrees that in consideration for the City paving that portion of the
above -described street/alley which abuts Owner's property, Owner herein voluntarily
consents to an assessment against such property and the placement of a lien thereon in the
amount of S / o . 25� which amount shall also be a personal liability and charge against
the Owner in addition to an encumbrance on the property.
