RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public
needs, safety and welfare demand and create a public necessity for the acquisition of
additional easements for municipal public use and purposes, to -wit: for the
underground water line easements in the southwest Lubbock annexation area and
the City Council of said City finds it in the public interest and for public purposes and
municipal purposes to proceed with the acquisition of easements as needed for such
purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the permanent water line easement to the tract of land
further described in Exhibit "A", attached hereto, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof.
SECTION 2. THAT the owner of said tract, being George H. McMahan,
Inc., BE offered through the Right -of -Way Department of the City of Lubbock the
amount of $17,900 which is the amount appraised as the value and total damages for
the permanent water line easement and acquisition of said real estate purposes herein
stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is
hereby authorized and instructed to institute condemnation (eminent domain)
proceedings to acquire the permanent water line easement.

BEGINNING at a 1/2" iron rod with cap found in the North line of 82nd Street
(Spur 313) for the Southwest and beginning comer of this easement, whence the
Southwest comer of Section 31, Block A—K, Lubbock County, Texas bears South
02*23143" West, 55.00 feet and North 87038' 10" West, 60.02 feet;
THENCE Northwesterly, along the arc of a curve to the right and along the North
line of said 82nd Street (Spur 313), 25.23 feet to a 1/2" iron rod with cap, set
in the East line of Alcove Avenue for the Northwest comer of this easement,
said curve has a radius of 30.00 feet, a central angle of 4801015011, and a chord
that bears North 63032' 12" West with a distance of 24.49 feet;
THENCE South 87°38' 10" East, 2565.29 feet to a 1/2" iron rod with cap, set in
the North line of said 82nd Street (Spur 313) for the Northeast comer of this
tract;
THENCE Southwesterly, along the arc of a curve to the right and along the North
line of said 82nd Street (Spur 313), 18.46 feet to a 1/2" iron rod with cap, set
for the Southeast comer of this easement, said curve has a radius of 15.00 feet,
a central angle of 70031144", and a chord that bears South 57°05'58" West with a
distance of 17.32 feet;
THENCE North 87*38' 10" West, along the North line of said 82nd Street (Spur 313).
2528.79 feet to the Place of Beginning.
