HomeMy WebLinkAboutResolution - 3691 - Right Of Way Offer - Lena B Foster - Sewer Line Easement, Sec 6, Block A - 08_22_1991Resolution No. 3691 August 22, 1991 Item #17 HW:js RESOLUTION WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the pub- lic needs and welfare demand and create a public necessity for the acquisition of additional land for a temporary working easement for use in connection with the construction and installation of a sanitary sewer line, and this City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of such temporary work- ing easement as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a temporary working easement in, upon, along, over, under, along and across the following described tract of land located in Lubbock County, Texas, be acquired for public purposes and municipal purposes as set forth in the preamble hereof, to -wit: A temporary working easement 25.00 feet in width and more particu- larly described as follows: BEGINNING at a point which bears East a distance of 25.00 feet from the Northwest corner of the Northeast 1/4 of Section 6, Block "A," Lubbock, Lubbock County, Texas; THENCE N. 89052' E. a distance of 25.00 feet to a point; THENCE South a distance of 2642.00 feet to a point; THENCE West a distance of 25.00 feet to a point; THENCE North a distance of 2642.00 feet to the POINT OF BEGINNING. SECTION 2. THAT the owner of said tract, being LENA B. FOSTER, a widow, BE offered through the Right -of -Way Department of the City of Lubbock the amount of $500.00, which is the amount appraised as the value and total dam- ages for the acquisition of a temporary working easement in, upon, over, under, along and across said real estate hereinabove described, for the use and benefit of the City of Lubbock, Texas, for the purposes herein stated, and unless accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and instructed to institute condemnation (eminent domain) proceedings to acquire such easement.
