RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the pub-
lic needs, safety and welfare demand and create a public necessity for the
acquisition of additional land for public purposes and municipal purposes, to -
wit: for the widening of Avenue H, and this City Council of said City finds
it in the public interest and for public purposes and municipal purposes to
proceed with the acquisition of lands as needed for such purposes as afore-
said; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described tract
of land located in Lubbock County, Texas, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof, to -wit:
BEGINNING at a 1/2" iron rod, set in the North line of 2nd Place
for the Southwest and beginning corner of this tract, whence a
3/8" iron rod, found at the Southwest corner of Lot 3, Alicia
Addition to the City of Lubbock, Lubbock County, Texas, bears
North 87043/14/1 West, a distance of 97.75 feet;
THENCE N. 02016,451, E. a distance of 100.00 feet to a 3/8" iron
rod, found for the Northwest corner of this tract;
THENCE S. 87043,141, E. a distance of 35.25 feet to a 1/2" iron
rod, set in the West line of Avenue H, for the Northeast corner of
this tract;
THENCE S. 02016,451, W., along the West line of Avenue H, a dis-
tance of 100.00 feet to a 1/2" iron rod, set for the Southeast
corner of this tract;
THENCE N. 87*4311411 West, along the North line of 2nd Place, a
distance of 35.25 feet to the POINT OF BEGINNING.
CONTAINING: 3525.00 square feet (0.08 acres)
SECTION 2. THAT the owners of said tract, being JOE F. OWENS and his
wife, BETTIE J. OWENS, BE offered through the Right -of -Way Department of the
City of Lubbock the amount of $49,100.00, which is the amount appraised as the
value and total damages for the acquisition of said real estate hereinabove
described, for the use and benefit of the City of Lubbock, Texas, for the pur-
poses herein stated, and unless accepted forthwith, the City Attorney of said
City of Lubbock is hereby authorized and instructed to institute condemnation
(eminent domain) proceedings to acquire the fee simple title to said land as
hereinabove described for public purposes and municipal purposes.
