HomeMy WebLinkAboutResolution - 081370E - Urban Planning Grant Award - HUD - 08_13_1970RESOLUTION ACCEPTING AND PROVIDING FOR THE EXECUTION OF A PROPOSED URBAN PLANNING GRANT AWARD WHEREAS, under Section 701 of the Housing Act of 1954, as amended, the United States of America (herein called the "Government") has tendered to City of Lubbock, Texas (herein called the i "Planning Agency") a proposed Urban Planning Grant Award under which the Government agrees to make a Grant to the Planning Agency to aid in financing a Program, designated Program No. Tex. P-309; and, WHEREAS, the Planning Agency has given due consideration to said proposed Grant Award; and, WHEREAS, the Planning Agency is duly authorized, under and pursuant to the Constitution and laws of the State of Texas, to undertake and carry out said Program and to accept the Grant Award; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. The proposed Award, designated "Comprehensive Planning Assistance Grant, Program No. Tex. P-309", consisting of Parts I, II, and: III, - under and subject to the provisions, terms and conditions of which the Govern- ment will make an. Urban Planning Grant under Section 701 of the Housing Act of 1954, as amended, to the Planning Agency to aid in financing the cost of Program No. Tex. P-309, situated in Lubbock, Texas, is hereby in all respects accepted. SECTION 2. The Mayor is hereby authorized and directed to execute said Grant Award in two (2) counterparts on behalf of the Planning Agency, and the City Secretary -Treasurer is hereby authorized and directed to impress and attest the official seal of the Planning Agency, if any, on each such counterpart and to forward such counterparts to the Department of Housing and Urban De- velopment, together with such other documents relative to the acceptance and execution thereof as may be required by the Government. SECTION 3. The Mayor of this Planning Agency is hereby authorized to file requisitions, together with necessary supporting documents, with the Govern. ment, from time to time as Grant funds are required, requesting payments to be made to it on account of the Grant provided for in the Award, and to do and perform all other things and acts required to be done or performed in order to obtain such payments. SECTION 4. The Planning Agency agrees to abide by all of the provisions terms, and conditions of said Grant Award. SECTION 5. This Resolution shall take effect this 13th day of August, 1970. All costs charged; to tha program account c . shall bs supported by properly executed payrolls, time records, invoicas, ;.. contracts, and vquchars evidencing in proper detail the nature and pro- priaty of tha charges. Records and Inspections. Tha Planning Agency shall maintain full and -accurat.3 records with raspact to -all matters pertaining to the approved .t :activities covirad h3raundar. Th.; Governmant's authorized rapresen- . tativ::s shall have Fraa acc.;ss at all proper times to such records, and tha right to examin.; and audit the same and to make transcripts there- from and to inspect all data, documents, procaadings, and other matters related to tha approved activities. ! 10. Raports and Information. The* Planning Agancy will; at such times and in such manner as HUD may require, furnish HUD with p.:riodic reports .: f and statamants par^taining to tha approved activities and annual work program and other ralatad matters covered haraundar. .110 Tarmination or Suspansion of Grant. The Govarnmant may by written notice terminate or suspend a grant in whole or in part, or withhold ' paymant, in the avant that it finds that the Planning Agancy has (a) Failed ' to comply with Federal law or with any of thasa conditions, (b) Failed to ' carry out the annual work program asapprwad; (c) made unauthorized or improp3r use of grant funds, (d) submitted any application, report, or other documnnt which contains a misrepresentation of a material natura or is incorrect or incomplete .in any material respect; or (a) if for any reason continuaticn of the approved annual work program is rendered . improbable, unfeasible, impossible, or illagal . The Planning Agancy shall take such action relative to termination or suspension as may be ; ' requirad by the Govarnment in tha notice of termination of suspension. In such case termination or suspension shall not affect any otharwis2 ' val id and allowabl a obl igations made in good faith prior to receipt of notice of termination or suspension. 12.- Political Activity. No portion of program funds shall be used for any partisan political activity or to further the el action or defeat of any candidate for public office. All employees of the Planning Agancy shall +' observ3 the limitations on political activities to which thay may be subject - under the Hatch Act (5 U S.0 1501 at seq., 18 U' S C. 595). 13..' Such action shalt include, but not be limited to, the following: �.. employment, upgrading, demotion, or transfer, recruitment or recruit- "` i '• ment advertising, layoff or termination, rates of pay or other forms of i compansation, and selection for training, including appranticaship. Planning Agency agrees to post in conspicuous places, available to ' :mployaes and applicants for amploymant, noticas to be provided by tha Government ratting forth th3 provisions of this nondiscrimination clause. Tha Planning Agency will, in all solicitations or adv_rtisements for employees placed by or on behalf of tha Planning Agency, state that f ' all qualified applicants will raceive consideration for employment without ! . regard to raca, religion, color, sex, or national origin.
