Cone Et Al - Section 43 - 02_12_1970o G/27o RESOLUTION WHEREAS, the City Council of the City of Lubbock has heretofore deter- mined the necessity of extending and improving the runway facilities at West Texas Terminal due to the increased air traffic; and, WHEREAS, it has been determined by the Council that the hereinafter described land owned by A. L. Cone and wife, Annie Cone, and the Estate of Arunah S. Abell, III, is needed to permit the safe and efficient operation of the airport; and, WHEREAS, the Council has determined the value of said land and total damages, if any, to the owner, and all others, whose interest may appear, for fee simple title to be $30, 918. 00, and the Council finds such amount to be fair and equitable, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City of Lubbock acquire the fee simple title to the land hereinafter described for the purpose of permitting a more safe and efficient operation of the airport; said land being a 41. 224 acre tract of land out of Sectior. 43, Block A, H. E. & W. T. R. R. Co. Survey, Lubbock County, Texas, and being more particularly described as follows: BEGINNING at a point in the West line of Section 43, for the Northwest and beginning corner of this tract, whence the Northwest corner of Section 43, bears North 120. 19 feet; THENCE South. along the West line of Section 43, a distance of 1754. 52 feet to a point for the Southwest corner of this tract; THENCE East 30. 0 feet to a point for a corner of this tract; THENCE Northeasterly around the arc of a curve to the right, whose radius is 199. 7 feet, a distance of 156.84 feet to the end of said curve; THENCE North 45° 00' East 404.53 feet to a point fora corner of this tract; THENCE East 1458.46 feet to a point for the Southeast corner of this tract; THENCE North 900. 0 feet to a point for the Northeast corner of this tract; 0- THENCE West 1458. 46 feet to a point for a corner of this tract; THENCE North 45 e 00' West 404. 53 feet to the P. C. of a curve to the right; THENCE Northwesterly around the arc of a curve to the right, whose radius is 199.7 feet, a distance of 156.84 feet to the end of said curve; THENCE West 30. 0 feet to the PLACE OF BEGINNING. SECTION 2. THAT the owners, A. L. Cone and wife, Annie Cone and the Estate of Arunah S. Abell, III, and all others, if any whose interest may appear, be offered through the Right -Of -Way Department, the amount of $"3:0 918. 00 as the value and total damages, if any, for the fee simple title and acquisition of said land for the purpose herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for airport purposes.
