RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock an application for a grant, under the
Department of Transportation, Federal Transit Act, as amended, to provide for capital projects
for the period October 1, 1997 through September 30, 1999 and operating assistance for the
period beginning October 1, 1997, and technical studies for the period October 1, 1997 through
September 30, 1998, which shall be spread upon the minutes to the Council and as spread upon
the minutes of this Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.

AUTHORIZING RESOLUTION
Resolution No. 5688
Resolution authorizing the filing of an application with the Department of Transportation, United
States of America, for a grant under the Federal Transit Act, as amended:
WHEREAS, the Secretary of Transportation is authorized to make grants for a mass
transportation program of projects;
WHEREAS, the contract for financial assistance will impose certain obligations upon the
applicant, including the provision by it of the local share of the project costs in the program;
WHEREAS, it is required by the U.S. Department of Transportation in accord with the provision
of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for
assistance under the Federal Transit Act, as amended, the applicant gives an assurance that it will
comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation
requirements thereunder; and
WHEREAS, it is the goal of the applicant that minority business enterprises be utilized to the
fullest extent possible in connection with this project, and that definite procedures shall be
established and administered to ensure that minority businesses shall have the maximum
opportunity to bid upon construction contracts, supplies, equipment contracts, or consultant or
other services.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF LUBBOCK, TEXAS,
ON THIS 23rd DAY OF October , 1997, AS FOLLOWS:
1. That the MAYOR is authorized to execute and file an application on behalf of the CITY
OF LUBBOCK, TEXAS, with the U.S. Department of Transportation to provide aid in
the financing of capital projects for the period of October 1, 1997 through September 30,
1999, and operating assistance for the period beginning October 1, 1997, and technical
studies for the period of October 1, 1997 through September 30, 1998, pursuant to
Section 5307 of the Federal Transit Act, as amended.
2. That the MAYOR is authorized to execute and file with such application an assurance of
any other document required by the U.S. Department of Transportation effectuating the
purposes of Title VI of the Civil Rights Act of 1964.
3. That the GENERAL MANAGER of CITY TRANSIT MANAGEMENT COMPANY,
INC., is authorized to furnish such additional information as the U.S. Department of
Transportation may require in connection with the application for the program of
projects.
4. That the MAYOR is authorized to set forth and execute affirmative minority business
policies in connection with the program of projects procurement needs.
5. That the MAYOR is authorized to set forth and execute grant agreements on behalf of the
CITY OF LUBBOCK, TEXAS, with the U.S. Department of Transportation for aid in
financing and planning, capital, and/or operating assistance program of projects.
6. That the RESOLUTION shall take effect immediately upon its adoption.

CITIBUS PROPOSED CAPITAL PROJECTS
PROJECT DESCRIPTION
FY 1998
Replacement Vans and Expansion Vans
In order to maintain our compliance with ADA, additional vehicles are
necessary. Citibus intends to purchase 2 replacement vans. These vehicles will
be used to replace equipment which has exceeded its FTA recommended life
schedule. Citibus also intends to purchase 3 expansion vans. These vehicles will
be used to expand paratransit operations in order to meet increased demand for
service.

Associated Capital Maintenance, Spare Parts, and Vehicle Overhaul Funds
This would include the replacement and overhaul of engines, transmissions,
tires, and other main components needed in the maintenance area. These items
will be available for capital funding since their cost is at least 1/2 of 1 % of the
current fair market value of the rolling stock on which the items are to be used
and also capital assistance in an amount up to 20% of Citibus annual vehicle
maintenance costs after removing any associated capital maintenance items.

Construction of Bus Stops and Passenger Amenities
New construction of facilities and parking lots at Texas Tech University will
create the need for construction of additional bus pullouts on the campus,
rehabilitation of an existing bus pullout on the fixed route service at the South
Plains Mall is also needed. In addition to covering the costs for additional bus
pullouts, this will include signage and shelter placement for both the campus
service and the fixed route service.

Maintenance Facility Expansion; Demolition, and Construction
The current parking lot at the administrative/maintenance facility is not large
enough to accommodate the parking needs of Citibus' expanded fleet.
Additionally, there is insufficient space for employee parking. This project will
consist of the appraisal, purchase, and demolition of a building, as well as the
construction of a new parking lot. It may also include relocation costs for a
business which currently occupies the building which would be purchased.

Miscellaneous Support Equipment
This would include the purchase of computer technology; both software and
hardware; plus installation and maintenance tools required for fleet
maintenance. Specifically, this will include the purchase of automated
scheduling and dispatching computer software and related equipment for the
paratransit service.

CITIBUS PROPOSED TECHNICAL STUDIES
PROJECT DESCRIPTION
TRANSIT STATISTICAL STUDIES - SECTION 5307
Objectives
The objectives of this task are as follows: to examine the transit system operated by the
subsidized private operator, City Transit Management Company, Inc.; to prepare
recommendations for action which could improve service and/or reduce deficits; and to
update and review previous work with an ongoing process as may be required by the
Federal Transit Administration (FTA) for capital and operating assistance programs.
Proposed Work 1997-1998
I. Administration/Management
A. This program will allow Citibus' management staff and operations
and maintenance personnel to attend seminars, schools, training
sessions, computer training, and conferences to further their education
and professional development.
B. Funding
Total: $ 6,000
II. Data Development and Maintenance
A. This program will allow Citibus to prepare and/or coordinate
ongoing activities in the areas of. Title VI Certification, EEO Program
Certification, Minority Business Enterprise Participation; collection of
ridership and route data associated with the Semi -Annual Route
Analysis (SARA); and the annual update of the ADA compliance plan.
This program will allow Citibus to conduct short-range planning
activities in the areas of. FY 1998 Unified Work Planning Program and
Transportation Improvement Program. This program will also allow
for the planning and implementation of several recommendations
made by the Federal Transit Administration during the last triennial
review and the ongoing drug and alcohol regulations.
B. Funding

III. Short -Range Planning
A. This program will encompass all planning requirements necessary for
the ongoing technical study. The program will maintain the quality of
service, with the anticipated decline in federal operating assistance,
and ensure the continuation of ridership amid the recent increase in
fares. The study will continue to look for new and innovative
marketing strategies and revenue options. The end result will be
recommendations for improvement in all areas of the transit
operations.

IV. Welfare to Work Program Planning
A. This program will allow for work associated with transportation
planning for individuals needing transportation assistance as a result
of federal welfare reform. This will include both short-range and
long-range cooperative planning between Citibus, social service
agencies, and employees in addressing transportation issues
associated with the transition from public assistance to employment

NOTICE OF THE OPPORTUNITY FOR A PUBLIC HEARING
RE: City of Lubbock/Citibus Section 5307 Capital, Technical Studies, and Operating
Assistance Grant Application.
Notice is hereby given that an opportunity for a public hearing will be afforded, in the
Citibus Conference Room, 801 Texas Avenue, on September 30,1997 at 12:00 noon for
the purpose of considering projects for which financial assistance is being sought from
the Federal Transit Act of 1964, as amended. The financial assistance is as follows:
CAPITAL ASSISTANCE GRANT Program of Projects: this project will consist of the
following: the purchase of 2 replacement vans and 3 expansion vans for the Demand
Response Service, as required by the Americans with Disabilities Act (ADA); spare
parts and associated capital maintenance items which include engines, transmissions,
tires, and other main components; various pieces of maintenance, administration, and
operations equipment which include tools and computers; the construction, purchase
and procurement of bus pullouts and shelters; the expansion of the
administrative/maintenance facility parking lot; rehabilitation of the bus wash facility;
and the purchase of bicycle racks for city route system buses.
This project is estimated at $2,223,000. Of this, $1,781,700 will be provided by the
Federal Transit Administration (FTA) Section 5307 funds, $441,300 will be provided by
local funds. This project is proposed to begin October 1,1997 and be completed by
March 31,1999.
TECHNICAL STUDY GRANT Program of Projects: this project will consist of the
following: training and travel for professional development; development of a five-year
capital plan and five-year marketing plan; conducting short-range planning; Welfare to
Work program planning; and the purchase of office equipment, including computers.
This grant is estimated at $117,000. Of this amount, $101,600 will be provided by FTA
Section 5307 funds and $15,400 will be provided by the City of Lubbock. This project is
proposed to begin October 1,1997.
OPERATING ASSISTANCE GRANT Program of Projects: this project will consist of
providing the transportation services in the Lubbock urbanized area, which are
provided by City Transit Management, Inc., d/b/a Citibus and includes the following:
1) Providing the transportation services beginning October 1,1997. This
portion of the grant is estimated at $3,420,000, of which $1,710,000 will be
provided by FTA Section 5307 funds, $482,500 by the City of Lubbock,
$600,000 by the Texas Department of Transportation (TxDOT), and
$627,500 by non-farebox revenues.
Interested persons or agencies may submit, orally or in writing, evidence and
recommendations with respect before 11:00 a.m. September 30,1997. The preliminary
Program of Projects is available to the public at the Citibus offices, located at 801 Texas
Avenue. The final projects will also be available to the public at the Citibus offices.

The applicant understands and agrees that the use of FTA funds approved for this project shall
be consistent with the applicable sections of the Federal Transit Act, as amended, Sections 3,
3(a)(1)(C), 4(1), 6, 8, 9, 9B, 10, 16(b)(2),18, or 20, or 23; U.S.C. Sections 103(3), (4), and 142;
pertinent Federal laws; and pertinent Federal rules, regulations, or circulars; and that the use of
FTA funds is subject to audit and review. Such funds shall be returned to FTA if, after audit, it
is found that they have been used improperly. Further, the applicant certifies or affirms the
truthfulness and accuracy of the contents and statements submitted on or with this statement
and understands that the provisions of 31 U.S.C. Sec. 3801 et sea are applicable thereto.
The applicants eligibility to receive FTA grants, as originally certified in the Opinion of
Counsel, remains in effect. Further signature of the attorney is certification that there is no
pending or threatened litigation or other action which might adversely affect the ability of the
grantee to carry out the project/ program.

ATTENTION: Whoever, in any manner within the jurisdiction of any department
or agency of the United States, knowingly and willfully falsifies or conceals a material
fact, or makes any false, fictitious, or fraudulent statements or representations, or makes

CHARTER SERVICE AGREEMENT
City Transit Management Company, Inc., d/bla Citibus, 801 Texas Avenue, Lubbock, Texas,
wishes to enter into a Charter Service Agreement with Texas, New Mexico, and Oklahoma
Coaches, Inc. (TNM&O), 1313 13th Street, Lubbock, Texas, in compliance with the Federal
Transit Administration (FTA) Charter Service Regulation (49 CFR Part 604). This agreement
will outline the charter service that Citibus may lawfully provide in the Lubbock urbanized area.
Citibus proposes to provide charter service between October 1, 1996, through September 30,
1999, Monday through Sunday, 24 hours a day, within 50 miles of the Lubbock urbanized area,
with NovaBus and GMC RTS H coaches and lift -equipped vans and trolleys.
The terms of the Agreement are as follows:
1. Citibus will provide charter service directly to governmental entities and entities subject or
otherwise eligible for exemptions from federal taxation under Section 501(c), Subsections
(1), (3), (4), and (19) of the Internal Revenue Code (i.e., Texas Tech University and the
City of Lubbock).
2. Citibus will continue to provide charter service directly to Texas Tech University athletic
events to current subscribers (five subscribers for football games and one subscriber for
basketball games).
3. Citibus will continue to provide subscription charter service directly to Lowe's
Supermarkets, United Supermarkets, Century 21 Realtors, First Baptist Church, Trinity
Church, and Indiana Avenue Baptist Church.
4. Citibus will charter directly to all parties requesting trolley charter service in the Lubbock
urbanized area.
5. Citibus will provide charter service directly to all parties requesting service that is
accessible to persons with disabilities.
6. Citibus will refer all other charter service requests to TNM&O. Citibus wishes to be

GRANT PROPOSAL EVALUATION FORM
1. State, as clearly as possible, the goals and objectives of the proposed project
for which a grant is being sought.
To provide Lubbock citizens with dependable and economical public
transportation, while maintaining the lowest feasible fares and minimizing the
need for local taxpayer support. To provide the planning funds to justify the
need for capital and operating assistance. Specific goals are as follows: to meet
the needs of the disabled community as well as the general population by
obtaining grant funding for the replacement of two (2) and the expansion of
three (3) demand response vans with larger capacity low -floor vans; construction
of bus passenger amenities for Texas Tech University and the regular fixed route
service, such as bus pullouts, shelters, and signage; purchase of property and
construction of a parking area for vehicle fleet and employee parking;
rehabilitation of the bus wash maintenance facility; bicycle racks for all buses in
service; computer software and hardware for administration/maintenance,
including software for scheduling demand response service; and various minor
maintenance and administrative equipment; to minimize the need for local
taxpayer subsidy by capitalizing the purchase of vehicle spare parts, which
reduces the local funding required.
A. Is this the fulfillment of an identifiable community (Lubbock) need? If so,
please provide quantifiable data (studies, etc.) that illustrate the
community needs and how this grant will meet that need:
Yes. The purchase of five (5) demand response service vans will provide
transportation service to persons with disabilities. This transportation is
needed to allow persons with disabilities the ability to be active members
of the community. This grant will also provide operating assistance to
Citibus which will allow for the continuation of transportation services to
the citizens of Lubbock.
2. List at least three measures by which City Staff and City Council might be able
to evaluate the program in order to determine that it has reached the goals and
objectives described in Question 1.
Passengers per hour (fixed route and demand response service); numbers of
passenger trips per year on fixed route system; number of passenger trips per
year on demand response service.
3. Will this program benefit the Lubbock community as a whole? If not, please
provide a detailed profile of the individuals or groups that will benefit from
the program.
Yes; the primary users of the Citibus transportation system are: low income
individuals without any other means of transportation, disabled individuals
(both physical and mental), the elderly who are unable to drive, and school and
college students. The demand response service is provided for those passengers
unable to utilize the fixed route service due to a disability.
4. Are other agencies (other than the City of Lubbock) available to administer
this program? If so, list the agencies:
There are no other agencies in the City of Lubbock currently available to
administer this program.
S. Are other agencies administering similar programs? If so, list the other
agencies. If not, why not?
There are no other agencies currently providing public mass transportation
services to the citizens of Lubbock. This is because the City of Lubbock has been
designated the recipient of Federal funding and has designated Citibus as the
provider of such services.
6. Is the program or activity provided by this grant required by state or federal
law, or required as a condition of other ongoing state or federal programs?
Please explain:
The state and federal governments do not require that cities operate public
transportation services; this decision was made by the City of Lubbock. Since the
service is provided, there are state and federal regulations that must be met in
order for the City of Lubbock to continue to qualify for assistance.
To come into compliance with the Americans with Disabilities Act (ADA), a
transportation plan was developed with public input. The plan was required to
identify the demand for the service and the time frame within which the demand
would be met. The purchase of five (5) demand response service vans will
greatly assist Citibus in meeting the demand and is a part of the ADA plan.
7. Does the grant require a local match? If so, in what amount? Is the match in
the form of cash or an in -kind contribution?
YES - a cash match is required.
(1) Capital projects - A match of 20% is required on all of the following projects,
with the exception of the purchase of bicycle racks, which is matched at 10%,
with the City share equaling $3,300. The City share will be $381,300 (including
the bicycle rack purchases), which is: $104,000 for five (5) demand response
vans; $80,000 for capital maintenance items; $20,000 (City share) for construction
of passenger amenities for the Texas Tech University campus service and fixed
route service (Texas Tech will pay $60,000 for their share of this construction);
$129,000 for the purchase of property and construction of parking area; $15,000
for rehabilitation of the bus wash maintenance facility; and $30,000 for the
miscellaneous maintenance and administration capital items.
(2) Operating assistance - A match of at least 50% of the net expenditures is
required. The local funding is as follows: $482,500 from the City of Lubbock;
$749,200 from Texas Tech University; $173,300 from route
guarantee/advertising; and $600,000 from the State.
(3) Planning - A match of 20% is required for all planning and technical studies.
The City share will be $15,400.
8. Is the grant for capital or operating programs? Please describe specifically
what the funds will be used for (personnel, supplies, services, capital outlay,
capital projects, etc.).
The grant contains capital, operating, and planning items.
Capital:
Five (5) demand response vans
Vehicle spare parts and capital maintenance items
Passenger amenities for Texas Tech University and Fixed Route System
Purchase of property/construction of parking area
Rehabilitation of Bus Wash Maintenance Facilities
Purchase of Bicycle Racks

Operating.
To maintain the current quality of service to the citizens of Lubbock
through the operation of the Citibus public mass transportation system.
Planning.
Technical study to allow Citibus to operate the maximum amount of
service at the lowest possible fare. The study will identify areas where
service should be modified to better serve the citizens. The study will
continue the ongoing route analysis and review to minimize the
requirements for local taxpayer support of public mass transportation
services.
A. If the grant is for capital outlay or capital project, will it result in ongoing City
operational costs? If so, explain in detail.
The replacement vehicles will require fuel and maintenance parts on a continual
basis, thereby creating operational costs. These costs should be no more than
Citibus previously expended.
B. If the grant is for operating program or programs, is it a one-time grant which
will results in ongoing City expenses, if the program is to be continued in the
future?
The operating program is applied for on an annual basis, thereby creating
ongoing City expenses.
C. Does the grant require continuation of the program, at City expense, after the
grant funding has expired? If so, how long will the City be obligated to
expend local funds, and in what areas? Be specific.
The grant does not require the continuation of the program at City expense after
the grant funding has expired. However, the City would be required to sell all
assets purchased with the assistance of the Federal Transit Administration and
return its portion of the proceeds, if the service were to be discontinued.
9. Is the grant a one-time grant with an option to renew the grant, or an ongoing
grant? If the grant is ongoing, how many years has the grant been provided to
the City, and what year does the upcoming period represent (2Ad year, 51h year,
etc.)? If the grant has an option to renew, how often can it be renewed, and
what are the terms of renewal? Please explain.
The grant is a one-time grant; the capital and planning portions may extend over
a three (3) year period. The operating portion of the grant begins October 1,
1997, and continues until all funds are utilized. This is different from in the past,
so as to take advantage of the remaining Federal Operating Assistance funds.
10. Are indirect costs reimbursed by the grant?
Indirect costs associated with the operation are reimbursed at 50%. Indirect costs
associated with the planning aspects of the grant are reimbursed at 80%.
11. Are grant audit costs reimbursed by the grant?
Yes, audit costs are reimbursed at 50%.
12. What is the immediate (twelve-month) impact of the grant program on City
employee allocation and utilization? How will this affect their work hours,
productivity, etc., on City program and activities?
Citibus is managed by a private firm, and has no City employees. Some City
services will be utilized by the activities in this grant; these are: City Manager,
Division Director, Legal Department, and Purchasing Department. It is not
anticipated that the activities in this grant will adversely affect these
departments.
13. What is the long-term (five-year) financial and manpower impact of the grant
program, both on the community and on the City organization?
The City of Lubbock will receive $3,593,300 in Fiscal Year 1998 from the Federal
Transit Administration to assist in the operation, capitalization, and planning
activities associated with the operation of public mass transportation services. It
is likely that similar funding will be received in future years. The City
employees will not be adversely affected by this grant, but approximately 130
Citibus employees would be affected by the discontinuation of the program. The
community would greatly suffer by the discontinuation of this program. Citibus
provides an excess of 4 million passenger trips per year to the citizens of
Lubbock. Many of these individuals would be required to forego medical, work,
and school trips if the Citibus service was reduced or eliminated.
14. Provide, in as much detail as possible, a 5-year Revenue and Expenditure
Projection for the grant related program, beginning with the current year, or
the first year this grant will be in effect. Show any ongoing costs to the City,
even if the grant is only for one year. If the grant is renewable or ongoing,
show the estimated revenues and expenditures for future years that you intend
to renew/continue the grant (up to five years). BE sure to fully explain the
source and types of revenues (in -kind contribution, reimbursement of
expenses, etc.) and fully explain the specific types of expenditures (payroll for
1/2 time clerk, purchase desk, capital project construction, etc.). Attach
additional sheets if necessary.
