ORDER AND RESOLUTION
AN ORDER AND RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LUBBOCK SITTING AS A REGULATORY AUTHORITY PURSUANT TO THE PUBLIC
UTILITY REGULATORY ACT OF 1995 (VERNON'S ANN.CIV.ST., ART. 1446c-0) WITH
REGARD TO AN ELECTRIC TARIFF FOR GRAIN ELEVATOR SERVICE FILED BY
SOUTHWESTERN PUBLIC SERVICE COMPANY AND BY LUBBOCK POWER AND
LIGHT WITH THE CITY OF LUBBOCK.
WHEREAS, Southwestern Public Service (SPS) has heretofore filed an Application for
Approval of a new Grain Elevator Service Tariff; and
WHEREAS, Lubbock Power and Light (LP&L) also desires to implement a new Grain
Elevator Service Tariff; and
WHEREAS, implementation of the proposed tariffs will make Grain Elevator Service
available within the City of Lubbock on the same basis as is currently approved by the Public
Utility Commission of Texas for areas outside the City; and
WHEREAS, this proceeding involves a rate reduction for all affected rate payers, so no
publication of notice is required; and
WHEREAS, all affected rate payers have been given notice by mail of the proposed rate
change; and
WHEREAS, the proposed tariff will not constitute a major rate change requiring a formal
public hearing under PURA 1995; and
- WHEREAS, the proposed tariff is just and reasonable and is not unreasonably
preferential, prejudicial, or discriminatory and complies with the requirements of §2.202 of
PURA 1995; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT, pursuant to PURA 1995, it is ordered and resolved that the proposed electric tariff
for Grain Elevator Service as proposed by SPS and LP&L is approved for use within the City of
Lubbock effective 35 days after the application was filed with the City of Lubbock for said tariff.
Passed by the City Council this 9th day of October , 1997.

RE: Application of Southwestern Public Service Company for Approval of a New
Grain Elevator Service Tariff
Dear Mayor Sitton and Members of the City Council:
On June 18, 1997, Southwestern Public Service Company ("Southwestern")
obtained approval of a new grain elevator service tariff from the Public Utility Commission
of Texas for services outside the City's jurisdiction. This new rate reduced grain elevator
rates by replacing the monthly minimum charge with an annual minimum charge. This
application with the City is to make this same grain elevator tariff available to the
customers within the City.
Enclosed are Southwestern's Application for Approval of the New Gain Elevator
Tariff, with the Tariff attached, and a proposed Ordinance approving the Tariff.
Simultaneously with filing this application, Southwestern is sending notice of this
application to each affected utility customer. Given this is a minor tariff approval request,
no publication notice or hearing is required on this application.
Please post notice of this request for the City's next Commission meeting sitting in
its regulatory authority to approve the proposed Tariff.

APPLICATION FOR NEW GRAIN ELEVATOR SERVICE TARIFF
SOUTHWESTERN PUBLIC SERVICE COMPANY ("Southwestern') files this application
for approval of a new grain elevator service tariff within the City and would show as follows:
I.
On June 18,1997, Southwestern obtained approval of anew grain elevator service tariff from
the Public Utility Commission of Texas. The new tariff will have the same per kilowatt-hour and
service availability charge as the current grain elevator service tariff. However, the monthly
minimum demand charge will be replaced by an annual minimum to reduce the minimum charge
during low usage months. Southwestern is filing this application with the City so that grain elevator
customers within the City will have the same low rates as are available under the proposed tariff in
Southwestern's Texas service territory outside the City.
II.
The new grain elevator service tariff, which is attached to this application as Exhibit "A,"
has the same per kilowatt and service availability charges as the current grain elevator service tariff.
However, an annual minimum charge has replaced the monthly minimum charge to give grain
elevator customers who have dramatic seasonal -use fluctuations relief from the monthly minimum
charge and its ratchet effect. This revision will result in an overall reduction in the grain elevator
customers' bills, especially in the late spring and summer months when their usage is low.

Southwestern requests approval of the proposed new grain elevator service tariff to be effective 35
days after the date of the filing of this application and tariff.
The rates established under the proposed tariff, as well as the terms and conditions of service
under the tariff, are just and reasonable, and not unreasonably preferential, prejudicial, or
discriminatory, and comply with the requirements of § 2.202 of the Public Utility Regulatory Act
of 1995 C PURA 1995").
IV.
Simultaneously with filing this application, Southwestern is giving notice of the proposed
rate change by mail to all affected customers. Since all affected utility customers will experience
a rate reduction as a result of the approval of the proposed tariff, Southwestern requests that the City
waive the publication of notice.
V.
The tariff requested herein does not constitute a major rate proceeding under § 2.212 of
PURA 1995 for which a public hearing is required.
VI.
The City has jurisdiction over this proceeding under § 2.101 of PURA 1995.
WBEREFORE, PREMISES CONSIDERED, Southwestern Public Service Company prays
that the City post notice of this request for its next Commission meeting sitting in its regulatory
authority under § 2.101 of PURA 1995 and that it approve the proposed new grain elevator service

APPLICABLE: Under contract, to all electric energy used for the operation of grain
elevators. Service is to be supplied at one point of delivery and measured through
one kilowatt-hour meter. All grain elevator customers are to be served under this
rate schedule, except customers having a measured demand of 200 kW, or greater,
may be served under the large general service rate.
Not applicable to temporary, breakdown, standby, supplementary, resale or shared
service.
TERRITORY: Texas service territory.
RATE: Service Availability Charge: S 15.40 per month
5360 per kWh for the first 1,000 kWh used per month*
3.350 per kWh for the next 6,000 kWh used per month
2300 per kWh for the next 11,000 kWh used per month
1.1 Bg for all additional kWh used per month
*Add to the 536¢ block,145 kWh for each kW of demand in excess of 10 W.
TERMS OF PAYMENT: Net in 16 days after mailing date; 5 percent added to bill after 16
days. If the sixteenth day falls on a holiday or weekend, the due date will be the next
work day.
DEMAND: The kW demand from Company's demand meter for the 30-minute period of
customer's greatest use during the month.
FUEL COST RECOVERY: The charge -per -kilowatt hour of the above rate shall be
increased by the applicable fuel cost recovery factor per kilowatt hour as provided in
Tariff Number 7100.

GRAIN ELEVATOR SERVICE
TAX ADJUSTMENT: (Applicable to sales inside corporate limits): Billings under this schedule
may be increased by an amount equal to the sum of the taxes payable under federal, state
and local sales tax acts, and of all additional taxes, fees, or charges, (exclusive of ad
valorem, state and federal income taxes) payable by the utility and levied or assessed by
any governmental authority on the public utility services rendered, or on the right or
privilege of rendering the service, or on any object or event incidental to the rendition of
service, as the result of any new or amended laws after June 30, 1965.
CHARACTER OF SERVICE: A-C; 60 hertz; single or three phase, at one available standard
voltage.
hIIN'Mf M ANNUAL CHARGE: $30.00 base revenue per kW of demand for the highest kW
demand recorded during the contract year. In the event that the minimum owed is greater
than $1,000, the customer may request that payment be split into three equal payments, the
first one due in the current billing month and one in each of the next two billing months.
TERM OF CONTRACT: A period of not less than one year.
LLNE EXTENSIONS: Ile Company will make tine extensions in accordance with its standard
line extension policy.
