HomeMy WebLinkAboutResolution - 121169D - Drainage & Utility Easement Abandoned - Alexander Land Addition - 12_11_1969``, RESOLUTION WHEREAS, it has come to the attention of the City Council that an encroa ment exists upon a postion of a drainage and utility easement abutting Lot 31, Alexander Land Addition to the City of Lubbock, Lubbock County, Texas, as more particularly described herein; and WHEREAS, it has been determined by the City Council that the portion of the said drainage and utility easement abutting Lot 31 of the Alexander Land Addition wherein the encroachment exists is not needed for a drainage and utility jeasement or for other public use; NOW THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the drainage and utility easement located on Lot 31, Alexander iLand Addition to the City of Lubbock as hereinafter described shall be and the same is hereby vacated and abandoned, for a drainage and utility easement I purpose; 1 BEGINNING at a point which bears 48. 64 feet West and 54. 25 feet South of the Northeast corner of said Lot 31, said point being at the Southeast corner of i a two story brick apartment building; I THENCE North along the East wall of said building a distance of 2. 2 feet; THENCE South 530 519 West along the easement line 1 a distance of 3. 72 feet to the intersection with the South wall of the building; 1 THENCE East 3. 00 feet to the PLACE OF BEGINNING. I THAT this vacating is expressly made subject to any and all other ease- ments and reservations shown on the plat of said addition. THAT the City Engineer is hereby authorized and directed to mark the official map of the City of Lubbock to indicate that the drainage and utility easement as described in Section 1 hereof, has been vacated and abandoned. THAT the Mayor of the City of Lubboc}t, be and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Quit Claim Deed in favor of Lorin Kumley, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail.
